<br />Section 6. Implementation <br /> <br />Requirements for Adoption of the Park Fees <br />The following are the requirements for adoption of the Development Impact Fee Nexus Study and <br />proposed park fees. <br /> <br />1. At least 14 days before the regularly scheduled meeting, mail out notice to any <br />interested party who requests notice of the adoption of new or increased impact <br />fees. Government Code Section 66017 <br /> <br />2. At least 10 days before the "open and public meeting" the local agency is to make <br />available to the public the Development Impact Fee Nexus Study. Government <br />Code Section 66016(a) <br /> <br />3. The local agency shall conduct at least "one open and public meeting" as part of <br />a regularly scheduled meeting. Government Code Section 66016(a) <br /> <br />4. Park fees take effect 60 days after adoption of the resolution or ordinance. 13 <br />Government Code Section 66017(a) <br /> <br />Deposit and Accounting of Fee Revenue <br />The following are the requirements for depositing and accounting for the park fee revenue. <br /> <br />1. Revenue derived from park fees should be deposited, invested, accounted for and <br />expended in accordance to Government Code Section 66006. <br /> <br />2. Quimby in-lieu fee funds and impact fee funds should be deposited into separate <br />accounts so that there will be not commingling of fees with other revenue.14 The <br />park fees should be expended solely for the purpose for which they were <br />collected. Any interest earned by such account should be deposited in that <br />account and expended solely for the purpose for which originally collected, <br /> <br />3. Within 180 days after the last day of each fiscal year, the information specified in <br />Government Code Section 66006(b) shall be made available to the public. <br /> <br />13 Whether the park fees are adopted by ordinance or resolution should be determined by County Counsel. It is <br />desirable that the specific fee amounts be set by resolution to better facilitate annual inflationary adjustments. <br /> <br />14 This may be necessary because the Quimby Act is referenced in the subdivision codes.
