<br /> <br /> <br />to <br />encumbrances or assessments, except easements or minor <br />title acceptable to the City. deeds for the transfer the property to the <br />City shall be recorded at the same times as a final plat or other recorded <br />document. <br /> <br />C) Applicants shall provide finished grading and ground cover for all land <br />dedicated for parks, playgrounds, and public open spaces. The removal of <br />trees or topsoil, storage of construction equipment, burying of construction <br />debris, or stockpiling of surplus soil on dedicated land or land purchased by <br />the City is forbidden without the written approval of the City. <br /> <br />Subd. 4. Amount of Dedication. The amount of land required to be dedicated shall <br />be in an amount equal to the proposed land use's proportional share of the park and open <br />space system within the City as determined by this section. A land use's proportional <br />share shall be determined as follows: <br /> <br />A) A residential development's proportional share is the per capita residential <br />share multiplied by the number of residents expected in the development. <br /> <br />B) A commercial/industrial development's proportional share is the per capita <br />commerciallindustrial share multiplied by the number of employees <br />expected in the proposed development. <br /> <br />C) A school's proportional share is the per capita residential share multiplied <br />by the number of students expected to attend the school who live outside of <br />the City. <br /> <br />The dedication requirements based upon the proposed use's proportional share of the <br />park space system the City are <br />may request a deviation from the presumptive requirements based upon the anticipated <br />impact of that particular use. The request must be made to the City Council as part of an <br />application for final approval. <br /> <br /> <br />Subd.5. Cash Contribution in Lieu of Dedication. The City may elect to receive a <br />cash contribution in lieu of a land dedication. The cash contribution shall be calculated <br />by the City estimating the fair market value of an acre of similarly zoned property in the <br />City and then multiplying that figure by the number of acres required to be dedicated <br />under this section. <br /> <br />4 <br />
