<br /> <br />462.357, subd 6(s) provides <br />certain circumstances; and <br /> <br />WHEREAS, On April 6, 2005, the Planning Commission held a hearing on the <br />Beauclaire variance and subdivision requests. One neighbor was present to support the <br />subdivision but to caution about the private sewer and pumping systems. He recommended a new <br />city sewer line as an alternative. The Planning Commission recommended approval of the <br />variances and subdivision 6-0 based on the findings in Section 5 of the project report and subject <br />to the conditions within Section 6 of the project report dated April 6, 2005, and including <br />payment of park fee by applicant (if required after attorney review) and, if requested on the new <br />parcel, side yard variances will be required rather than setback permits. <br />WHEREAS, based on findings as outlined in Section 5 of the project report dated April <br />25,2005, the Community Development Staff recommends approval of the variance requests, and <br />subject to the conditions outlined in Section 6 of the project report dated April 25, 2005; <br /> <br />a. The City policy is to require payment of the Metro Area Sewer Availability <br />Charge (SAC) upon the issuance of a building permit. In this case, a $1,350 SAC <br />fee is required and will be collected with the issuance of a building permit for <br />Parcel "A". <br /> <br />b. The applicant must record the two lot minor subdivision survey within 60 days <br />after the approval of the City CounciL Public utility and drainage easements of 5 <br />feet are required on the sides and rear lot line, while a 10 feet right of way <br />easement is required on the east Dale Street frontage. In addition, a private utility <br />easement across parcel B in favor of Parcel A for private sanitary sewer placement <br />must be recorded with the survey. <br /> <br />c. The applicant must apply for and receive a driveway access permit for Ramsey <br />County prior to issuance of any building or grading permit. <br /> <br />d. A grading plan and the survey ("B" above) must be submitted with the building <br />permit application. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Schroeder and upon vote being taken thereon, the following voted in favor: Ihlan, <br />Maschka, Schroeder, Kough, Klausing <br /> <br />and the following voted against: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
