<br /> <br /> <br /> <br />to <br /> <br /> <br />4.3 1005.01 (Minimal structures to be set <br />a minimum of 30feetFom a property adjacent a public street (corner lot). <br />sign, as by the Development is a structure <br />to meet the principal structure setback of 30 feet. <br /> <br /> <br />4.4 Section 1 009.08E limits pylon and ground signs to a maximum size of 1 00 sq. ft. in a <br />General Business District. <br /> <br />4.5 Section 1009.08G states: The height ofpylon signs shall be limited to 20feet in B-1, B- <br />1 B, b-2, B-3, B-4 and B-6 districts and 25feet in SC and 1 districts. <br /> <br />4.6 The City Planner has determined that since the initial construction of 1963, the landscape <br />surrounding the Dairy Queen has matured, making it difficult to properly and <br />appropriately notice/view the pylon sign. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 The proposal by Daniel Smith seeks to relocate the existing pylon sign closer to the front <br />property line adjacent to Lexington Avenue. The applicant proposes to locate the sign 1 <br />foot from the west property line, similar to those sign variances approved at the B- Dale <br />Club, Brentwood Town Offices, and Kinderberry Hill Child Care. A similar sign <br />variance was also approved for the Press Gym, but that variance was required to be a <br />minimum of 5 feet from the City path. <br /> <br />5.2 Since August of 1963 the pylon sign has stood (as best as records indicate) in the same <br />location. However, the small evergreen trees along the north property line have matured <br />to over 40 feet in height and the saplings and underbrush south of the subject parcel and a <br />part of Lake Josephine Park, have also matured. As well, Lexington Avenue was <br />reconstructed and relocated within the existing right-of-way, and the curb edge now lies <br />27 feet from the west (front) property line on the north and 40 feet from the west (front) <br />property line on the south. The total pylon setback distance from the curb based on the <br />existing situation is 57 to 70 feet. <br /> <br />5.3 The City Planner has determined that there is justification for granting a VARIANCE to <br />Section 1005.01 of the Roseville City Code to allow the relocation of the existing pylon <br />sign at 3070 Lexington avenue (Dairy Queen) 1 foot from the property line. <br /> <br />PF3639 _RVBA_050405.doc - Page 2 of 5 <br />
