Some considerations include: <br /> <br />1) City Code does not mention or define a "Half-Way House". It simply <br />IS as a permitted use in an R -1 zone or any other zone. <br /> <br />2) The City Code, Section 1004, does allow a home owner, living in the <br />home within an R-l single family district to have up to two boarders. The <br />Code also allows a total of four unrelated occupants within one dwelling <br />unit. <br /> <br />3) The City Code, Section 1004, does allow for state licensed adult day care <br />or group home as a permitted use. Those provisions relate to State Statute <br />462.357, Subd. 7. and licensure under Mn. Rules 9502.0315 to 9502.0445. <br />(This may be the most direct approach to create a conforming use.) <br /> <br />4) The City Code has a provision for an interim use permit, Section 1012.09, <br />which the previous owner applied for (for office uses) and received, has <br />been approved for the structure and parcel at 2256 Lexington, and which <br />runs through September 2006. You could ask the City Council to amend this <br />permit from office to half-way house. A copy of the interim use permit is <br />attached. <br /> <br />1 <br />
