The City Council shall be the approving authority <br />for any or all extensions ofthe pennit. The Council may refer the application <br />for extension to the Planning Commission for study and recommendations <br />action thereon if the Council detennines that special problems or <br />circumstances may exist with regard to the proposed extension. There is no <br />vested right or legal entitlement to an extension and the decision on any <br />application for extension shan be within the sole discretion of the City <br />Council. <br /> <br />13. The City Council shall, in all cases, retain continuing jurisdiction over each <br />such pennit and may, at any time, either on its own initiative or in response to <br />a violation of the tenns ofthe pennit, modify or delete any conditions of the <br />pennit or impose any new conditions if necessary in order to preserve the <br />public health, safety and welfare, or to prevent the creation or continuance of <br />a public nuisance, or where such action is necessary to preserve or restore any <br />of the findings set forth in this resolution. Prior to Council action, the <br />Planning Commission shall conduct a public hearing on the proposed <br />modification to the pennit conditions and notice thereof shall be given in the <br />same manner as prescribed in Section 108 and Section 1012. <br /> <br />14. Violations of the tenns of this Interim Use Pennit shall be considered grounds <br />for revocation of the Interim Use Pennit at anyone time or grounds for denial <br />of a pennit extension to a further five-year period. An interim use pennit may <br />be revoked upon a detennination by the City Council that the holder of such <br />pennit has failed to comply with any of the conditions thereof or has violated <br />any applicable provision of the City Code. Prior to Council action, the <br />Planning Commission shall conduct a public hearing on the revocation and <br />notice thereof shall be given in the same manner as prescribed in Section 108 <br />and 1012. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Member <br />Kysylyczyn, and upon a vote being taken thereon, the following voted in favor thereof: <br />Maschka, Klausing, Goedeke and Kysylyczyn, and the following voted against the same: <br />none. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />5 <br />
