Agenda Date: 4/1/2015 <br />Agenda Item: 6a <br />Division Approval Agenda Section <br />Item Description: Request by the Community <br />Development Department to continue the discussion of amending in its <br />entirety Title 11, Subdivision, of the City Code <br />1 <br />At its July 2014 meeting, the Planning Commission began the series of discussions and public <br />2 <br />hearings about the development of the new Subdivision Code. During the initial conversations, <br />3 <br />the topic of revised classifications of subdivisions and the simplified procedures related to them <br />4 <br />was identified as one of the more significant changes proposed for the new subdivision code. <br />5 <br />6 <br />The existing subdivision code allows for several variations of subdivisions, as identified below. <br />7 <br />common wall subdivisions: creating two separate ownership parcels from a duplex <br />8 <br />property; <br />9 <br />recombinations: relocating the shared property line(s) of two abutting parcels altering <br />10 <br />their size or shape but not creating additional parcels; <br />11 <br />consolidations: converting two adjacent parcels under common ownership into a single <br />12 <br />parcel; <br />13 <br />corrections: correcting the location(s) of property boundaries which differ from a parcel’s <br />14 <br />legal description; <br />15 <br />minor subdivisions: dividing existing parcels into two or three totalnewparcels; and <br />16 <br />plats: a more formalized process of establishing parcel boundaries and legal descriptions, <br />17 <br />perhaps creating new parcels for development and/or new roads. <br />18 <br />Each of these types of subdivision has procedures that differ from one another in seemingly <br />19 <br />arbitrary ways. The proposed subdivision code groups them into three categories, namely Type 1, <br />20 <br />Type 2, and Type 3 subdivisions, based on their relative similarity or difference from one <br />21 <br />another, and establishes procedures for each type. The part of the proposed subdivision code <br />22 <br />discussing these subdivision types and their respective procedures are included with this RPCA <br />23 <br />as Attachment A. <br />24 <br />Based on feedback in the last discussion about the subdivision types, the proposed draft has <br />25 <br />changed slightly and the number of types has been reduced a bit. Generally speaking, Type 1 <br />26 <br />subdivisions are the recombination, consolidation, and correction requests that may change the <br />27 <br />configuration of existing residential parcels but do not create additional ownership interests or <br />28 <br />parcels for development; Type 1 subdivisions are proposed to be administratively reviewed <br />29 <br />without seeking public input, much like they are today. <br />30 <br />Type 2A subdivisions would allow for these same actions on all parcels (not just residential <br />31 <br />parcels); Type 2A subdivisions are also proposed to be administratively approved without <br />32 <br />PROJ0001_RPCA_Rewrite_040115 <br />Page 1 of 3 <br /> <br />
