��� <br />� <br />REQUEST FOR COUNCIL ACTION <br />Department Approval <br />Item Description: Approve Contract for Civil Legal Services <br />BACKGROUND <br />Date: Apri120, 2015 <br />Item No.: 8.e <br />City Manager Approval <br />Since 2010, Erickson, Bell, Beckman, & Quinn (EBBQ) has provided the City civil and <br />prosecutorial legal services. The initial contract was three years pursuant to the City policy on <br />professional services. In 2012, the City solicited proposals for legal services through a <br />competitive process. As a result of that process, the City Council agreed to continue EBBQ's <br />service to the City. The existing contract expires at the end of 2015. <br />As previously mentioned the City's policy requires that professional services are rebid every <br />three years. As part of the policy, there is an ability to waive the competitive process by vote of <br />the City Council. In reviewing EBBQ's work on both civil and prosecutorial services, Staff finds <br />their work superior and recommends that their contract be extended an additional three years and <br />that the City does not solicit bids for legal services. <br />EBBQ has submitted drafts of the professional services agreement for civil and prosecutorial <br />services for the City Council's consideration. (Attachment A). The level of services are <br />identical to the existing agreements. <br />POLICY OBJECTNE <br />The City requires legal advice and services as part of its essential functions. Entering into a <br />contract for legal services will allow for the City to receive proper legal advice in its operations <br />and provide for prosecution of violations of law. <br />BUDGET IMPLICATIONS <br />The draft agreements provide for a flat fee retainer for both civil and prosecutorial services. The <br />retainer fee for 2016 will be same as the 2015. The agreement then provides for 3% increases in <br />2017 and 2018. In 2016, the cost for prosecution services will be $12,653 per month and <br />� $15,560 per month for civil legal services. Similar to the existing contract, legal work as part of <br />��� litigation against the City will be charged non-retainer fees. These amounts are unchanged from <br />the existing contract. <br />STAFF RECOMMENDATION <br />� Staff recommends waiving the requirement of the professional services policy and entering into <br />the agreements for legal services. <br />Page 1 of 2 <br />
