EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 31 st day of March, 2003, at 6:30 p.m. The following members were present: Schroeder, Klausing, kough, Maschka and Kysylyczyn and the following were absent: None Council Member Schroeder introduced the following resolution and moved its adoption: RESOLUTION NO. 10082B A RESOLUTION APPROVING A NINE FOOT VARIANCE TO SECTION 1004.02D5 OF THE ROSEVILLE CITY CODE FOR PROPERTY LOCATED AT 2080 FARRINGTON AVENUE (PF 3454). WHEREAS, Daniel Boerigter has requested a variance to Section 1004.02d5 of the Roseville City Code in allow construction of an entry porch2l feet from the front property line; and WHEREAS, the Boerigter parcel is located at 2080 Farrington Avenue and legally described at as: Thornton's Subdivision of the Northeast Quarter of Section 13, Township 29, Range 23, subject to Burke Avenue and excluding the South 555 feet of the East 124-47/100 feet of Lot 10. PIN: 13-29-23-12-0045. WHEREAS, Section 1004.02D5 requires each residential property in Roseville to have a minimum front yard setback of 30 feet from the front property line; and WHEREAS, Mr. Boerigter proposes to construct an entry porch that would encroach nine feet into the required 30 foot setback or to a point 21 feet from the front (that property line adjacent to Farrington Avenue) property line; and WHEREAS, the Roseville Planning Commission held the public hearing regarding the Boerigter variance request (Section 1004.02D5) on March 5, 2003, and recommended (5-1) approval of the request, based on findings outlined in Section 5 and conditions of Section 6 of the project report dated March 5, 2003. NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant Daniel Boerigter a nine foot variance to Section 1004.02D5 of the Roseville City Code to allow construction of an entry porch 21 feet from the front property line at 2080 Farrington Avenue, based on the findings in Section 5 and of the project report dated March 31, 2003 and subject to the following conditions: 3
