EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL OF CITY OF ROSEVILLE RAMSEY COUNTY, MINNESOTA Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, Minnesota, was held in the City Hall in said City on Monday, March 31, 2003 at 6:30 o'clock p.m. The following members were present: Schroeder, Klausing, Kough, Maschka and Kysylyczyn and the following were absent: none. Councilmember Kysylyczyn introduced the following resolution and moved its adoption: RESOLUTION 10085 RESOLUTION AUTHORIZING USE OF CITY PROPERTY AT FAIRVIEW AVENUE AND COUNTY ROAD C FOR PATHWAY AND STORM WATER RETENTION IN CONJUNCTION WITH THE COUNTY ROAD C RECONSTRUCTION PROJECT WHEREAS, the City of Roseville is the fee owner, manager, and operator of certain real property in the City of Roseville, County of Ramsey, State of Minnesota, in the southeast comer ofthe County Road C and Fairview A venue intersection which is more particularly described on the attached Exhibit "A", hereinafter referred to as "Property".; AND WHEREAS, one of the necessary public improvements as part of the County Road C Reconstruction project is the placement of storm water runoff into the existing storm water retention area adjacent to Fairview Avenue on a portion of said Property; AND WHEREAS, a portion of said public improvements in said County Road C Reconstruction also includes the reconstruction of public pathways and a temporary construction easement to expire on December 31, 2004 on a portion of said Property; AND WHEREAS, the City of Roseville hereby consents to the use of said land described on attached Exhibit "A" for storm water runoff, public pathway purposes and temporary construction easement to be constructed as part of said County Road C reconstruction project; AND WHEREAS, the City of Roseville further declares that the storm water runoff and pathway rights shall run with said real property and be binding on all parties having any right, title or interest in said Property or any part thereof, their heirs, successors and assigns; THEREFORE BE IT RESOLVED by the City Council of the City of Roseville, Minnesota, hereby authorizes the use of the property described on Exhibit "A" to be used for storm water runoff, public pathway purposes and temporary construction easements. The motion for the adoption of the foregoing resolution was duly seconded by Member Maschka, and upon a vote being taken thereon, the following voted in favor thereof: Schroeder, Klausing, Kough, Maschka and Kysylyczyn, and the following voted against the same: none. WHEREUPON said resolution was declared duly passed and adopted.
