The Board of Trustees when acting as the Board of Trustees, is hereby authorized to direct payment of said service pension provided that all qualifications are met as set forth herein. All applications for benefits must include a certified copy of the death certificate of the pensioner. Section 42A Post-Retirement Increases Whenever the amount of the service pension per year of service credit is increased for active members of the Association upon their qualification therefore, the amount of the service pension payable to each Pensioner or other retirement benefit recipient receiving a service pension as of January 1, 1980 and thereafter, may be increased by the same amount per year of service credit. Section 43 Monthly Service Pension The monthly service pension payable to an eligible retiring member shall be equal to the Maximum Service Pension determined by reference to Minnesota Statutes §424A.02 Subd. 3 based upon the average amount of available financing per active covered firefighter determined on or before August 1 st of each year as provided by Section 25 herein. Payment of all service pensions (monthly, lump-sum and deferred) shall commence on the First (1St) day of the month next following approval of the application by the Board of Trustees. Payment shall terminate on the latter of (a) the date of death of the Pensioner, or (b) the date of death or remarriage of the Surviving Spouse; or (c) when no child or children of the Pensioner are minors.- The Board of Trustees shall establish from time to time the form of Application required to be submitted with such supporting documents as may be necessary, by an applicant for death or service pension benefits. In the event that the Board of Trustees shall determine that payments made to a Pensioner, a Surviving Spouse or to a minor child or minor children, in error, the Board of Trustees shall be entitled to reclaim the erroneous payments without interest and the recipient by acceptance of the payment, agrees to forthwith reimburse the Association to the full extent of payments made in error. Section 44 Lump Sum Service Pension The Board of Trustees is authorized, at the option of the eligible retiring member, to pay a service pension to the retiring member in a lump sum, or upon written election of the 17
