Perhaps the most newsworthy portion of the new state law is the so-called "Sunday <br />growler" provision, which can be found as a new 302.13.G in this draft. Please note that <br />the new state law permits the City to choose the hours of sale. I have inserted 5:00 a.m. to <br />10:00 p.m. here, so as to be consistent with weekday/Saturday retail off-sale regulations <br />within the City. But, again, this is an item that the Council has discretion to alter. <br />5. Finally, I would alert the Council and staff to a provision in state law that might be <br />relevant to local businesses: under Minnesota Statutes section 340A.22, subd. 2(e), "No <br />single entity may hold both a cocktail room and taproom license, and a cocktail room and <br />taproom may not be co-located." While this mandate is not expressly set forth in existing <br />City Code or in my draft amendments, it is important to note that this state law provision <br />does apply in Roseville nonetheless and the Council cannot override it. The Council <br />certainly has the discretion to make this an express part of City Code, however. <br />Please let me know if you have any further questions or comments on this draft.
