Department Approval <br />�:i � <br />� <br />REQUEST FOR COUNCIL ACTION <br />Date: June 15, 2015 <br />Item No.: l 0.a <br />City Manager Approval <br />Item Description: Consider Amending City Code Chapter 302 Liquor Control to Allow for Off- <br />and On Sale Microdistillery Sales and to Allow for Sunday Sales of Growlers <br />BACKGROUND <br />The Minnesota State Legislature recently adopted new laws allowing cities to permit Off-Sale <br />Microdistilleries and On-Sale Microdistillery Cocktail Rooms. The recent law changes also now allow <br />of Off-Sale of growlers on Sunday. The City Manager instructed the City Attorney to draft an <br />ordinance amendment to reflect the change in state law for the City Council to consider and potentially <br />adopt. <br />The City Council discussed the proposed changes on June 8 and instructed the Attorney to make <br />additional corrections for consideration at the next available meeting. The Attorney has provided a <br />memo detailing the proposed ordinance and a red-lined draft showing potential changes to Chapter 302. <br />The City Council <br />POLICY OBJECTIVE <br />�� Administering and controlling the dispensing of liquor is an important regulatory function of the City. <br />� Amending City Ordinances to reflect State law allows for continued enforcement of liquor control <br />regulations while providing the business community and consumers a choice on how liquor is sold and <br />consumed. <br />FINANCIAL IMPACTS <br />� Allowing for additional licenses will provide for a small increase in fee revenue. There will be minor <br />administrative and enforcement costs with the new licenses. The fee schedule will need to be amended <br />to accommodate the new licenses if they are created. <br />STAFF RECOMMENDATION <br />Staff recommends that the City Council review the proposed ordinance change and consider adopting <br />changes to the ordinance as they deem desirable. <br />REQUESTED COUNCIL ACTION <br />The City Council should review the proposed ordinance change and consider adopting changes to the <br />ordinance as they deem desirable. <br />Prepared by: Pari-ick Trudgeon, City Manager (651) 792-7021 <br />Page 1 of 2 <br />
