<br />WHEREAS, said Terrace Drive extension will cross the property on which the <br />Centennial Gardens West Apartments are located; and <br /> <br />WHEREAS, the owners of the Centennial Gardens West Apartments and the City <br />have been unsuccessful in reaching an agreement to purchase the needed land; and <br /> <br />WHEREAS, title to the land underlying the street extension is needed as soon as <br />possible so that construction can begin in a timely fashion, and so that emergency access <br />is available during construction; and <br /> <br />WHEREAS, the City Council approved a motion on March 31, 2003, to take all <br />actions necessary to acquire street right of way for the Terrace drive extension. <br /> <br />NOW, THEREFORE, BElT RESOLVED by the City Council that City staff is <br />directed to immediately proceed with acquisition of the land necessary for the extension <br />of Terrace Drive to the Applewood Pointe property. Said acquisition is to be either <br />through continued negotiation and/or condemnation pursuant to the City's eminent <br />domain authority. <br /> <br />Member Kough seconded the foregoing Resolution and upon a vote being <br />taken thereon, the following voted in favor thereof: Klausing, Maschka, Schroeder, <br />Kough and Kysylyczyn. <br /> <br />and the following voted against the same: None <br /> <br />Whereupon said Resolution was declared duly passed and adopted. <br /> <br />Dated: June 9, 2003 <br /> <br />\\Victoria\CommDev\Planning Files\34So-3499\34S7 _United Properties\Terrace Drive Resolution 060903.doc <br /> <br />2 <br />
