91 amended zoning provisions, but the amendment may take a considerable amount of time to <br />92 complete given the level of detail required, its potentially large scope, and the fact that the <br />93 amendment is not the Engineering Division's highest priority project. Planning Division staff <br />94 believes that such a conundrum represents a practical difficulty which the variance process is <br />95 intended to relieve. <br />96 Roseville's Development Review Committee (DRC) met on November 13, 2014 to discuss this <br />97 application and the only concern about the proposal was the lack of specifications about the <br />98 proposed pervious paving system to confirm that the proposal is, in fact, consistent with the <br />99 anticipated amendment. A draft engineering proposal has since been provided which details how <br />loo the proposed driveway can be constructed to achieve 50% perviousness; the proposal is included <br />101 with this RVBA as Attachment D. The applicant should continue working with Engineering <br />102 Division staff for approval of appropriate materials and construction techniques. <br />103 OUTSIDE AGENCY REVIEW <br />104 Notice of this application was mailed to Minnesota Department of Natural Resources' (DNR) <br />105 Area Hydrologist; no comment was offered by the DNR. <br />106 PUBLIC COMMENT <br />107 At the time this report was prepared, Planning Division staff has not received any <br />108 communications from the public about the variance request. <br />109 RECOMMENDED ACTION <br />110 Adopt Variance Board Resolution 110 approving a variance to § 1004.08 of the City Code to <br />111 allow the proposed excess paved surfaces and building footprints at 365 S Owasso Boulevard, <br />112 subject to the following conditions: <br />113 a. The driveway shall utilize materials and installation methods that are determined by the <br />114 City Engineer to achieve at least 50% perviousness as proposed and reviewed with the <br />115 variance application; and <br />116 b. Impervious surface area shall be limited to 25% of the parcel area, and the applicant shall <br />117 continue to work with Engineering Division staff to complete the Residential Storm <br />118 Water Permit process or otherwise comply with comparable City regulations in place at <br />119 the time of construction to install and maintain the pervious pavement. <br />120 ALTERNATIVE ACTIONS <br />121 a. Pass a motion to table one or more of the items for future action. Tabling beyond <br />122 January 7, 2015 may require extension of the 60 -day action deadline established in Minn. <br />123 Stat. §15.99. <br />124 b. Adopt a resolution to deny the requested approval. Denial should be supported by <br />125 specific findings of fact based on the Variance Board's review of the application, <br />126 applicable zoning or subdivision regulations, and the public record. <br />127 NEXT STEPS <br />128 The decision of the Variance Board is final unless an appeal is filed.
