Request by Cities Edge Architects for Approval of an Amended <br />Common Interest Community Plat at 2�15 Long Lake Road <br />City Planner Thomas Paschke briefly summarized this request providing a new <br />description of Unit 6 for the addition of a small swimming pool, as detailed in the RCA <br />dated June 8, 2015; and supported unanimously by the Planning Commission with one <br />condition. <br />Councilmember Willmus questioned if this was considered a replat or subdivision. <br />Mr. Paschke responded that it was shifting lot lines, and would be more indicative of a <br />recombination or subdivision. <br />Councilmember Willmus asked if there was any ramification regarding the park <br />dedication. <br />At the request of Mayor Roe, City Attorney Gaughan advised that, while no new lots <br />were being created, it was questionable from his perspective whether new ordinance <br />language addressing one acre minimum lot size was triggered. However, as with any <br />subdivision, it was necessary to show there was a need created to trigger a park <br />dedication, and given the uniqueness of this request, he found that provision <br />questionable at best. <br />Mr. Paschke advised that this request was presented to the Parks & Recreation <br />Commission at their meeting last week, and they requested a park dedication, which <br />would ultimately need to be addressed by the City Attorney before a final plat comes <br />before the City Council for approval. <br />The applicant was present but had no comment beyond staff s presentation; and no <br />public comment was provided on this issue. <br />For clarification purposes, Mayor Roe noted this was a Preliminary, not Final, Plat <br />approval. <br />McGehee moved, Laliberte seconded, approval of the proposed changes to Unit 6 of <br />Rosedale Corporate Plaza Condominium AMENDED PRELIMINARY CIC PLAT; based <br />on the comments, findings and conditions as detailed in the RCA dated June 8, 2oi5. <br />Since this is some of the last green space available in that area, Councilmember Etten <br />spoke in support of considering a park dedication fee with the intent to look at City Code <br />based on that rationale in this case. <br />Roll Call <br />Ayes: Laliberte, McGehee, Willmus, Etten and Roe. <br />Nays: None. <br />
