552 <br />553 <br />554 <br />555 <br />556 <br />557 <br />558 <br />559 <br />560 <br />561 <br />562 <br />563 <br />564 <br />565 <br />566 <br />567 <br />568 <br />569 <br />570 <br />571 <br />572 <br />573 <br />574 <br />575 <br />576 <br />577 <br />578 <br />579 <br />580 <br />581 <br />582 <br />583 <br />584 <br />585 <br />586 <br />587 <br />588 <br />589 <br />590 <br />591 <br />592 <br />593 <br />594 <br />595 <br />Attachment A <br />Section 40 Death Benefits - Causes During Active Duty <br />Upon the death of a member caused while acting and perForming duties as a firefighter, <br />the Surviving Spouse, or if none, the member's estate, shall receive the sum of 10% of <br />the 20 year service pension; provided written notice of the injury and evidence of it as the <br />cause of death is given to the Board of Trustees within thirty (30) days after such injury. <br />Any payment made pursuant to the terms of this Section 40 shall not preclude a Surviving <br />Spouse, or if no spouse survives, a minor child or minor children from making any <br />application and receiving any additional benefits to which the Surviving Spouse or minor <br />children might otherwise be entitled pursuant to the terms of these Bylaws. <br />Section 41 Death Benefits - Causes Other Than During Active Duty <br />Upon the death of a member who does not qualify for a service pension by reason of <br />having less than 20 years of service in the Roseville Fire Department and less than 10 <br />years as a member of this Association, from causes while not acting and perForming <br />duties as a firefighter, the sum of 1/20t" of the 20 year service pension per year of service <br />not to exceed the ten year vested pension for each year of service shall be paid to the <br />Surviving Spouse or if no spouse survives, a minor child or pro rata to the surviving minor <br />children. Year of service shall mean the quotient obtained by dividing total months of <br />service by twelve. A remainder of less than six months shall be disregarded, and a <br />remainder of six months or more shall be counted as one year. <br />Section 42 Pension - 10 Years in Association - 20 Years Roseville Fire <br />Department <br />Anyone who has been a member of this Association for at least ten (10) years and who <br />has served twenty (20) years in the Roseville Fire Department and who has reached the <br />age of fifty (50) years, may make application to the Board of Trustees for a service <br />pension and receive the service pension hereafter set out, providing the application <br />therefore is received by the Board of Trustees not later than sixty (60) days after the <br />applicant retired from service. <br />This service pension may be increased or decreased by the Board of Trustees from time <br />to time within the limits set herein and in accordance with Minnesota law and the <br />provisions of these Bylaws. The applicant for such service pension shall release this <br />Association from any and all claims and payment of benefits except the sum established <br />for such pension. Neither said years of service nor said years of inembership need be <br />consecutive; however, time while on leave of absence and time under suspension shall <br />not be included in determining total time preconditions for pension benefits. <br />Upon the death of such Pensioner, the Surviving Spouse shall continue to receive the <br />service pension so long as the spouse does not remarry. In the event that such <br />Pensioner does not leave a surviving spouse, then the balance of the service pension <br />benefits to which such Pensioner was entitled shall be payable as limited herein to the <br />surviving minor child or pro rata to the surviving minor children.
