<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 15th day of December, 2003, at 6:30 <br />p.m. <br /> <br />The following members were present: Kough, Maschka, Klausing, Schroeder, <br />Kysylyczyn <br />and the following were absent: None <br /> <br />Council Member Kysylyczyn introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10167 <br />A RESOLUTION APPROVING A 39 FOOT VARIANCE TO SECTION 1016.16A OF <br />THE ROSEVILLE CITY CODE FOR JIM BADZINSKI <br />385 SOUTH OW ASSO BOULEVARD (PF3540). <br /> <br />WHEREAS, Jim Badzinski has requested a VARIANCE to Section 10 16.16A of the <br />Roseville City Code to allow the construction of an attached deck on the lakeshore side of the <br />principal structure he owns; and <br /> <br />WHEREAS, the Badzinski parcel is located at 381 South Owasso Boulevard, and legally <br />described as: <br /> <br />Lot 11, Lake Owasso Villa <br />PIN: 01-29-23-21-0002 <br /> <br />WHEREAS, Section 10 16.16A (Placement of Structure on Lot) requires a principal <br />structure to be set back a minimum of75 feet from the ordinary high watermark of a lake; and <br /> <br />WHEREAS, the deck proposed by Mr. Badzinski would be located 36 feet from the <br />ordinary high watermark of Lake Owasso; and <br /> <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />Badzinski request on December 3,2003, recommending (6-1) approval of a 39 foot VARIANCE <br />to Section 1016.16A of the Roseville City Code, based on the findings of Section 5 and <br />conditions of Section 6 of the proj ect report dated December 3, 2003; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE a <br />39 foot VARIANCE to Section 1016.16A of the Roseville City Code for Jim Badzinski, 381 <br />South Owasso Boulevard, subject to the following conditions; <br /> <br />a. The deck being a maximum size of 12 feet by 16 feet. <br /> <br />b. The property owner locating and identifying in the field the top of bluff on the <br />parcel for use by the City in determining the required setback. <br /> <br />1 <br />
