EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 15th day of December, 2003, at 6:30 p.m. The following members were present: Kough, Maschka, Klausing, Schroeder, Kysylyczyn and the following were absent: None Council Member Kysylyczyn introduced the following resolution and moved its adoption: RESOLUTION NO. 10168 A RESOLUTION APPROVING A VARIANCE TO SECTION 1016.16B1 OF THE ROSEVILLE CITY CODE FOR JIM BADZINSKI 385 SOUTH OW ASSO BOULEVARD (PF3540). WHEREAS, Jim Badzinski has requested a VARIANCE to Section 10 16.16B 1 of the Roseville City Code to allow the construction of an attached deck on the lake shore side of the principal structure he owns; and WHEREAS, the Badzinski parcel is located at 381 South Owasso Boulevard, and legally described as: Lot 11, Lake Owasso Villa PIN: 01-29-23-21-0002 WHEREAS, 10 16.16B 1 (Structure Design Standards - Bluff Impact Zones) reads: "Structures and accessory facilities, except stairways and landing, shall not be placed within bluff impact zones; and WHEREAS, the deck proposed by Mr. Badzinski would be located within the bluff impact zone (12 feet from the top of the bluff and 18 feet within the bluff impact zone); and WHEREAS, The Roseville Planning Commission held the public hearing regarding the Badzinski request on December 3,2003, recommending (6-1) approval of a VARIANCE to Section 10 16.16B 1 of the Roseville City Code, based on the findings of Section 5 and conditions of Section 6 of the project report dated December 3,2003; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE a VARIANCE to Section 10 16.16B 1 of the Roseville City Code for Jim Badzinski, 381 South Owasso Boulevard, subject to the following conditions; a. The deck being a maximum size of 12 feet by 16 feet. 1
