Regular City Council Meeting <br /> Monday,August 24, 2015 <br /> Page 36 <br /> as conditioned—should be installed at the northern edge of the property line if the <br /> easement language prohibits fence construction there, or installation at the north- <br /> ern edge of the easement point as the second option. <br /> At the request of Councilmember Willmus, City Attorney Gaughan agreed with <br /> the applicant's legal counsel that two weeks seemed a reasonable amount of time <br /> to obtain and verify easements. <br /> Councilmember Willmus suggested having this item return for formal action by <br /> the September 14, 2015 regular City Council meeting. <br /> Mayor Roe suggested, since the City Council condition was already memorial- <br /> ized, the only direction needed to staff was to clarify that the fence must be built <br /> on the property line or northern most point not encumbered by a utility easement. <br /> City Attorney Gaughan confirmed Mayor Roe's comments, including installation <br /> of coniferous plantings as part of that condition as well. <br /> McGehee moved, Etten seconded, clarification and direction to staff that the City <br /> Council's Interim Use condition of June 23, 2014, as referenced in the RCA dated <br /> August 24, 2015, that the opaque fencing of 6' to 8' in height, coniferous plant- <br /> ings, and landscaping will be installed along the northern property line in its en- <br /> tirety, unless easement agreement(s) preclude a fence from being installed at that <br /> point; and if so the installation will occur at the northernmost point allowed and <br /> tied into the eastern property line at that point. <br /> At approximately 10:00 p.m., Etten moved, Willmus seconded, extension of the curfew to finish <br /> this discussion, to hear the presentation and update related to the draft tree preservation ordi- <br /> nance amendments (Item 15.a), and to address any Councilmember initiated items for future <br /> meetings (Item 17). <br /> Roll Call <br /> Ayes: Laliberte, McGehee, Willmus, Etten and Roe. <br /> Nays: None. <br /> Willmus moved an amendment that if the easement requires fencing move to the <br /> south of the northerly property line, and if plantings are allowed on the easement <br /> in accordance with easement language, and if neighbors agree to it, plantings be <br /> located on the north side of the fence. Willmus further clarified the point, with <br /> agreement by the makers of the motion, that the plantings be placed on the north- <br /> ern edge of the fence, subject to easement requirements. <br /> The makers of the original motion agreed with that amendment, allowing for three <br /> possibilities to resolve this issue. <br />
