• The praposal is consistent with the Comprellensive Plan l�ecause the proposed <br />c�>vered entry advances the C'onlpreher�sive P1an's �c�als related to promoting� <br />maintenance and investment in the existing housing siock; <br />• The propasal is in harmony wit11 the purpases and intent of the front setback <br />requi�rements, which are desi�;ned tio organiz� homes in a consistent arrangement along <br />street frontages a�nd to ]�i�mit� bu�ilding mass near resident�ial streets, because the c.xistin� <br />principal struc;ture setback is legally nancanfarming and the prapased covered entry <br />would not add to the building mass or the appearance af further encroachtnent, and <br />because the scale ofthe propasal is in keeping with what would �e a permitted <br />improvement if t�he house lnet the frc�nt yard setback requirements. <br />+ The prc�posal puts the subject property to use in a reasanable manner because the <br />prapased covered entry, which is nonnally a permitted impravement under the roning <br />code, represents a comman use of the praperty. <br />• There are unique circumstances to fhe property which were nat created by the <br />landowner because the house and the platted parcel boundaries were established before <br />the institutic�n of a zoning code with setback requiretnents. <br />• The varia�nce, if �;��ranted, will not alter the �ssential character af the locality <br />because the pra}�ased cavered entry wc�uld not add the kind of mass that wauld make the <br />existing home appear ta encroach still farther toward the street and because the proposed <br />roof structure would allow inlproved functianal use of the harne in addition to impraving <br />rts appearance. <br />N�OW THEREFORE �E TT RESOLVED by xhe R�s�vi�lle Variance Board tc� apprave a <br />variance ta Section 1004.08 of the Raseville City Code, subject to the follawing canditians: <br />a. The applicant shall hire a surveyar to verify and, if necessary, re-set the two <br />lnonuments defining the front property line prior to applying for the necessary building <br />perm it; <br />b. The depth af the entire rc�of structux� shal�l be limited to t11e lesser of 6 feet or the <br />verified distance bet:ween the existing hause and the frant property line; and <br />c. If it is dei�nnined by the Gity En�;�ineer that the existing stairs encroach into the <br />front �boundary right-of-way, an Encroachme�nt A�;reeme�nt will be required at the <br />discretion of staff. <br />The �notion for the adopticrn «f �lle fore�c�ing resalutic7�n was duly seconded by Variance <br />Board M�;�nber Bo�usz�;wski and upc7�i vote bc:in�; t�ken thc�r�:�ri, the follc�wing voted i�n favor: <br />Gisselqu�ist, Boguszewski, and Strc�l�meier; <br />and none vated against. <br />WHEREUPON said resolutic>n was de�.lare�ci duly passed and adopted. <br />Pa�;e 2 cr�f 3 <br />
