<br />CITY OF ROSEVILLE <br />ORDINANCE NO. 1146 <br /> <br />AN ORDINANCE AMENDING CITY CODE SECTION 7.025 REGARDING GARAGE AND BOUTIQUE <br />~ES IN RESIDENTIAL DISTRICTS; ALLOWING UP TO 3 SALES PER YEAR FOR 3 DAYS EACH, NOT <br />TO EXCEED NINE (9) TOT AL DAYS PER YEAR. <br /> <br />The City Council of the City of Roseville ordains: <br /> <br />Section 1. Section 7.025 and 7.025(1) of the City Code is hereby amended as follows: <br /> <br />7.025. Garage and Boutique Sales in Residential Districts <br /> <br />Garage sales and residential boutique sales are permitted accessory uses in R-l, R-2, R-4, R-5, and R-6 <br />districts, but shall be limited to three - three consecutive day sales each calendar year per residential unit, and <br />shall not exceed nine (9) total days in duration per year. No single sale shall exceed 3 consecutive days in <br />length. The maximum daily hours of operation shall be 8:00 a.m. to 6:00 p.m. A residential boutique sale shall <br />not occupy more than four hundred (400) square feet of a residential unit. <br /> <br />F or the purposes of this section, garage sales and residential boutique sales are defined, as follows: <br /> <br />1. A garage sale is a sale of used household and personal items ,?onducted on residential premises, where <br />the property sold consists of items owned by the occupant of the premises at which the sale takes <br />place, or by mends of such occupant and where the sale is conducted by such occupant or mends, and <br />not by an agent or any other person to whom a commission, fee, or salary is paid. Items for sale shall <br />not have been purchased for resale or received on consignment for the purpose of resale. Except <br />during the sales day and one day before and after for setup, items for sale shall be stored within the <br />garage, screened :ITom view with opaque fencing or screening, or stored in the residence. No permit <br />is required for a sale which meet the criteria of this section. A property owner may apply for a garage <br />sale promotion permit in which the applicant requests the City Council to vary or approve additional <br />conditions beyond those stated in this code. <br /> <br />2. A residential boutique sale is the sale of handcrafted items conducted on residential premises, where <br />the items sold are made by the occupant of the premises at which the sale takes place, or by mends <br />of such occupant, and where the sale is conducted by said occupant or mends of such occupant and <br />not by an agent or any other person to whom a commission, fee, or salary is paid.
