For reference the City of Rosevi�le project file is PF3608. <br />1.0 EFFECTIVE DATE of AGREEMENT: <br />This AGREEMENT shall be effective upan completion of all of the following: <br />1.1 Passage and recording of this PUD AGREEMENT, amending the existing <br />Rosedale Shopping Center PUD of January 1, 2000 (Ordinance # 1234), with <br />specific terms and conditions for redevelopmentlexpansion of the Mall. <br />1.2 Execution of this AGREEMENT by the CITY and the DEVELOPER. <br />1.3 Approval of the Public Improvements Contract by the City Council of the CITY <br />and recording of the Amended & Restated Transit Hub Agreement (Rosedale), <br />dated June 20, 2005 and recording of any CITY approved public easements with <br />the Ramsey Caunty Recorder. <br />2.0 REQUEST far PUD APPROVAL: <br />The DEVELOPER has requested that the CITY approve an amendrnent to portions of <br />the existing Rosedaie Shapping Center Planned;Unit Development (PUD) of January 1, <br />2000 (Exhibit A) that provides for the removal of the three story 170,000 sq. ft. east <br />wing anchor departrnent store (farmerly known as Mervyn's) and redevelopment of <br />approximately 182,000 sq. ft. of retail space in a three story farmat, which include5 <br />123,708 sq. ft. (estimated) of retail space and a 58,678 sq. ft. (estimated) 14 screen <br />movie theater on 14.97 acres wherein the building area expands by appraximately <br />12,Op0 sq. ft., located at 1595 Highway 36 West, and iegally described as: <br />
