Attachment F <br />247 Community Development Directar for review and approval, which plan <br />2 4 8 shall include landscaped parking lot islands, landscaping adjacent to <br />2 4 9 buildings, and landscaping along all street frontages and the ring road in <br />2 5 0 accordance with the standards of the Regional Business District. If there <br />2 51 are practical difficulties that prevent full compliance with the landscaping <br />252 requirements on any particular development site, the DEVELOPER may <br />2 5 3 locate some of the required landscaping on other portions of the Rosedale <br />2 5 4 Mall property with the prior approval of the Community Development <br />2 5 5 Director. <br />2 5 6 9.6 Additional Standards in All Non-LDR Districts. The additional standards set forth <br />2 5 7 for all Non-LDR Districts set forth in City Code Section 101 L 11 shall apply, <br />2 5 8 subj ect to the following: <br />2 5 9 9. 6.1 Waste and Recycling Areas. The requirements set forth in Section <br />2 6 0 l 011.11.B shall be modified so that waste and recycling enclosures shall <br />261 be designed into the building or adjacent the building in a manner that is <br />2 6 2 fully screened from public view. <br />2 6 3 9.7 Parking and Loading A�eas. The requirements set forth in City Code Chapter <br />2 6 4 1019 shall apply, subj ect to the following: <br />2 6 5 9. 7.1 Bicycle Parking. The DEVELOPER shall provide/install bicycle racks, <br />2 6 6 lockers, and/or lock-up for a minimum of 50 bicycles distributed in the <br />2 6 7 Retail Addition, Parking Deck, and all main Rosedale Mall entrances, in <br />2 6 8 accordance with the Access, Circulation, and Parking Plan. <br />2 6 9 9. 7.2 Pedestrian Circulation and Access. The requirements set forth in City <br />2 7 0 Code Section 1019.14 shall apply, as modified by the Rosedale Road, <br />2 71 Access, Circulation, and Parking Plan. <br />272 10.0 MISCELLANEOUS: <br />2 7 3 10.1 This AGREEMENT shall be binding upon the parties, their heirs, successors, tenants, or <br />274 assigns, as the case may be. <br />2 7 5 10.2 Breach of any material term of this AGREEMENT by the DEVELOPER shall be <br />2 7 6 grounds for denial of building permits, except as otherwise provided in Section <br />2 7 7 10.3 If any portion, section, subsection, sentence, clause, paragraph or phrase of this <br />2 7 8 AGREEMENT is for any reason held invalid as a result of a challenge brought by the <br />2 7 9 DEVELOPER, its agents or assigns, the balance of this AGREEMENT shall nevertheless <br />2 8 0 remain in full force and effect. <br />2 81 10.4 This AGREEMENT shall run with the land and may be recorded in the Ramsey County <br />282 Recorder's Of�ce by the CITY. <br />2 8 3 10.5 This AGREEMENT shall be liberally construed to protect the public interest. <br />2 8 4 10.6 Due to the preliminary nature of many of the plans and the timing of the overall <br />2 8 5 development, addenda to this AGREEMENT may be required to address concerns not <br />2 8 6 specifically set forth herein. <br />11/11/15 Ver. 7 <br />
