2.�� were related to storm water and the effect of the proposed private street on the character of the <br />24� neighborhood. After discussing the application and the public comment received during the <br />2 f hearing, the Planning Commission voted 6— 0 to recommend approval of the proposed <br />2B preliminary plat. At the time this report was prepared, Planning Division staff has received one <br />29 brief comment from a nearby homeowner on Marion Road indicating his acceptance of the <br />3o proposal. <br />�� After reviewing the proposal, staff's analysis, and the public comment received at the public <br />s2 hearing, the Planning Commission voted unanimously to recommend approval of the preliminary <br />33 plat with four conditions as follow: <br />3�� a. The Public Works Department shall approve easements, grading and drainage, storm water <br />3�> management, and utility requi�ements as necessary to meet the applicable standards prior to <br />3� the approval of the final plat or issuance of permits for site improvements; <br />3� b. Permits for site improvements shall not be issued without evidence of an appNoved permit <br />3� fi^om the watershed district; <br />s9 c. Final plat approval shall not be issued without approval of a tree pNeservation plan, <br />4o accouniing for any changes to grading, utility, o� storm wate� plans not yet anticipated, <br />4�t by the Community Development Department; and <br />42 d. The applicant shall create and maintain a homeowner's association for the permanent <br />a3 and on-going maintenance needs of the private infNastructure. The fo�m of all documents <br />4� shall be reviewed and approved by the City Attorney, Public Works Department, and <br />4� Community Development Department. <br />4� In addition to the Planning Commission's recommendation, review of a previous proposal by the <br />4� Parks and Recreation Commission led to its recommendation to accept park dedication of cash in <br />4� lieu of land, which is reflected among the conditions of preliminary plat approval. <br />49 RECOMMENDED ACTION <br />5o Pass a motion approving the proposed preliminary plat of Oak Acres plat, dated November <br />5� 5, 2015 and comprising the property at 2201 Acorn Road, based on the findings and <br />�2 recommendation of the Planning Commission, the content of this RCA, public input, and City <br />5� Counci] deliberation, subject to the following conditions: <br />5^ a.
