The Contractor shall be liable for liquidated damages amount(s) upon <br />determination of the City of Roseville that performance has not <br />occurred consistent with the provisions of the contract. The City shall <br />notify Contractor in writing or electronically of each act or omission <br />in this Agreement reported to or discovered by the City. It shall be <br />the duty of Contractor to take whatever steps or action may be <br />necessary to remedy the cause of the complaint. <br />The City may deduct the full amount of any damages from any <br />payment due to the Contractor. The remedies available to the City <br />under this paragraph shall be in addition to all other remedies which <br />the City may have under law or at equity. <br />8.06. Services Not Provided For <br />No claim for services furnished by the Contractor not specifically <br />provided for herein shall be honored by the City. <br />9. INSURANCE AND OTHER LEGAL REQUIREMENTS <br />9.01. Insurance <br />Insurance secured by the Contractor shall be issued by insurance <br />companies acceptable to the City and admitted in Minnesota. The <br />insurance specified may be in a policy or policies of insurance, <br />primary or excess. Such insurance shall be in force on the date of <br />execution of the contract and shall remain continuously in force for <br />the duration of the contract. <br />Contractor shall provide a Certificate of Insurance as proof of general <br />liability coverage for bodily injury or death in the amount specified <br />by state law. <br />The Certificate of Insurance shall name the City as an additional <br />insured, and state that the Contractor's coverage shall be the primary <br />coverage in the event of a loss. <br />The Contractor shall also provide a Certificate of Vehicle Liability <br />Insurance in the amount of at least $1,000,000. <br />The Contractor shall further provide a Certificate of Professional <br />Liability Insurance or Errors & Omissions Insurance providing <br />coverage for 1) the claims that arise from the errors or omissions of <br />the Contractor or its sub -contractors and 2) the negligence or failure <br />37 <br />
