Last summ�r the Ci�y r�f Rosevil�.e approved a <br />plai for the property, The plat was also reliminaril a ' i <br />P y pproved by the Ramsey <br />County Plat Commission subject to fihe acquisition of signatures from all parties .� �' <br />of interest. Sinc� that time all signatures except Thafi of the first mortgagee, `���. <br />Provider�t Life Insuranc� Company of Philadelphia have been acquired. For < ;� <br />some reason Provident believes that it`� execution of the plat would somehow ;_ ;; <br />affect it's security interest in the property, We hav� argued with Provident ' <br />; �; <br />over the past several months that the plattir�g of the property onl� incrEases �� <br />th� value �f the project, We have also offered to prepay the martgage. <br />However, the terms of the mortgage provide �hat we cannat do so for at ]east <br />another year and a half. Provident has refused fio permit prepayment and rias <br />refused to execute the plat. <br />Dr. Fleck has a substantial amount of money invested in the platting, and <br />although he does not intend to b�gin selling the units immecliately, he would <br />like to get the plat filed. Also, there has k�een discussion of a reorganization <br />of the plat commission, and we are afraid that if the �lat is not filed bzfore this <br />occurs we might be gut to additional ex�ense . <br />In our recent telephone conversation I suggested that the plat might be converied <br />ta a registered land survey, the latter not requiring signatures of aniyone but <br />RosevilZe a�d the plat commission. The plat commission has indicated that an <br />RLS would �.e acceptable with them. Since th� plat does not contain any dedica- <br />tions, and with the above background in mind, I was hopeful that Roseville might <br />be agreeable to the conversion, <br />
