� <br />� <br />�� <br />II <br />� <br />L� <br />�J <br />� <br />� <br />I <br />� <br />� <br />�� <br />fJ <br />� <br />LJ <br />L�J <br />� <br />LJ <br />� <br />ARTICLE 41 - ARB,TRArj�i, <br />If arbitration �s ch�sen bv the pc3rttey to resolve any disp�te under the Contract <br />QocumQnts, �t sha�1 be conducted in accordance with the rules then in effect, of <br />the American Arbitrat�on ASsot�at.�On In that Event, the Contract Documents shall <br />be spec�fically enfo�ceabl� under the prevailing arbitrat�on law, and ,�;ia�gment upon <br />the award of the arbitr�,tors may be entered �n the Cuurt of the forum, state or <br />federal, having jurisdictTon. tf the -ppiicable statute of limita tions would bar <br />the institution of any legal or equitable proceedings based on any claim or dispute <br />under the Contract Documents, neither party shall have the right to seek arbitration <br />of such claim or dispute under• this Article. <br />ARTICLE 42 - MISCELLANEOUS <br />42.1 Whenever any provision of the Contract Documents requi.res the giving of <br />written notice it shall be deemed to have been validly given if delivered in person <br />to the individual or to a member of the firm or to an officer of the corporation <br />for whom it is intended, or if delivered at or sent by registered or certified <br />mail, pnstage prepaid, to the last business address known to I�im who giv��s the <br />notice. <br />42.� All mon,eys nc�t paid when due hereunder shall bear interE�st at th2 rate of <br />six per cent (6�) per annum comme�cing on the first day after the payment ;3 due <br />and continuing until the payment i� made. <br />42.3 Should the OW«ER or the ENGIfJEER or th� COPJTRACTOR suffer injury or damage <br />to �ts person or prope�ty because of an,� errOr, omission or act of the other <br />or of any of his employees or agents or others for whose acts he is legally liable, <br />cla�m shall be made �n writing to the other party within a reasonable time of the <br />first observance of such injury or damage, <br />42.4 The Contract Documents shall be governed by the law of the place where the <br />Work is to be performed. <br />G - 24 <br />
