0

❑
DATE:
TO:
FROM:
SUBJ'ECT :
M E M O R A N D U M
January 18, 1990
Craig Waldron
Rick Jopke
Complaint against Crown AutofB-Dale Amoco
I have reviewed the attached complaint and have determined the
followinga
1) The City does not require general business licenses.
Therefore, Crown Auto is not required to have a license to
do business in the City.
2) The City does require a license to operate a gasoline
station. B-dale Amoco has obtained the proper license to
oprate the gasoline service station. The current license
will expire June 30, 1990. The ordinance states that "The
Council may revoke any license for violation of this code or
any applicabl State ar Federal statute of regulation.' To
my knawledge, the attached complaint does not constitute a
violation of any city, state, or federal code or statute so
it would be ditficuit o revoke the license.
3) There are no oer city ordinances which govern the conduct
af this type o businesses in the City.
Th bottom l.irie is that I clon ° think the ity cart reasonably
close either of these usinesses down based on the attached
comalaint. It woulcl appear to be a}rivate matter which the
camplainant will have to reso.ve wYth the businesses. zn my
opiniori, the City sho i d not be involvel .
