� <br />� <br />� <br />DATE: <br />TO: <br />FROI�+I : <br />SUBJECT: <br />M E M O R A N D U M <br />August 16, 1988 <br />Craig Waldron <br />Rick Jopke � <br />Phone conversation with Dr. Larson at 1211 Josephine <br />Road. <br />I had a long phone conversation with Dr. Larson at 9:00 am <br />Tuesday, August 16, 1988. Dr. Lar�on expressed considerable <br />concern about a situation with his neighbor Frank Rekuski at 1225 <br />Josephine Road. Mr. Rekuski has substantially added on to his <br />dwelling. The addition does not comply with the city setback <br />requirements and was apparently constructed even though a <br />variance was turned down. Dr. Larson expressed a number of <br />frustrations about the city not resolving this situation. A <br />meeting attended by Dr Larson, Mr. Rekuski, Howard Dahlgren, <br />Gordy Beseth and myself occurred in April of this year at which <br />time we believed that an agreement had been reached between the <br />parties whereby Rekuski would go through a variance process and <br />he agreed to take a number actions to address Dr. Larsons <br />concerns. Rekuski has apparently not followed through with the <br />actions to Dr. Larsons satisfaction and indicated that he is <br />frustrated with the City because we are not enforcing our <br />ordinances properly. I explained to Dr. Larson that the city is <br />attempting to enforce the ordinances have informed Mr. Rekuski <br />that he has to either bring the dwelling in to compliance with <br />the ordinances, or attempt to get a variance. Mr. Rekuski is in <br />the process of applying for a full variance. I explained to Dr. <br />Larson the variance process and that he wil�. have ample <br />opportunity to express his concerns on the matter. I pointed out <br />to Dr. Larson that we would be glad to submit to the Planning <br />�Commission and Council any written statement that he would like <br />to make on this matter. I emphasized that ultimately the <br />decision would be made by the City Council on this matter based <br />on a recommendatian from the Planning Cammission, the testimony <br />that wa� received during the public hearing process and based on <br />the facts presented in the planning consultants report. Dr. <br />Larson asked what the city's position would be on this matter <br />and I explained to him that the city �taff does not take a <br />position in these matters, but just presents the pertinent facts <br />to the commission and council and they ultimately make the <br />ded:ision on the matter. <br />Finally, I gave the dates of <br />council meetings and told <br />informed on the progress on <br />we could. <br />the expected planning commission and <br />Dr. Larson ti�at we would keep him <br />the matter and assist him in anyway <br />
