M E M O R A N D U M <br />DATE: December 22, 1988 <br />TO: Steve North <br />FROM: Rick Jopke � -� <br />SUBJECT: Midland Chemical Upciate <br />It appears that a negotiation settlement has been reached <br />concerning the Midland Scientific Inc. operation at 1995 West <br />County Road B-2. As you may recall, the City originally issued <br />orders to remove hazardous chemicals on this site in November of <br />1987. City staff has also been working with the owners of the <br />site and with Midland to relocate them to bring them into <br />compliance with the City's zoning ordinance. The City amended <br />the zoning or��.�nance to allow chemical storage and distribution <br />uses by special use permit in the general industrial zoning <br />districts. <br />In April of 1988, the City approved a special use permit to allow <br />Midland to move to a new site at County Road C and Patton Road. <br />Midland scientific has not relocated and continues to aperate at <br />� 1995 County Road B-2. The special use permit for the new site <br />has lapsed and the City has issued a citation for various code <br />violations. <br />The basis of the settlement would entail the following: <br />1. Mr. McCormick, the owner, pleads guilty to the various code <br />violations. <br />2. Mr. McCormick is sentenced to 30 days for said viol��tion. <br />3. The City will support a suspended sentence based on the <br />requirement that Mr. McCormick be completely out of the <br />building by February 1, 1989. Mr. McCormick has apparently <br />purchased a new site for his business in Brooklyn Center. <br />4. If Mr. McCormick is not prop�rly vacated by Februar� 1, <br />1989, the City would then reqaire that his sentence be <br />properly servec�. <br />Staff had reviewed the poten�ial with Pam Zerin from the City <br />Attorney's office regarding inspecting the site with respect to <br />potential hazards that still exisL, however, Pam stated it would <br />be cleanest and "quicker" to ut.ilize the aforementioned <br />settlement. I will continue to keep you informed. <br />� <br />
