M E M O R A N D U M DATE: December 22, 1988 TO: Steve North FROM: Rick Jopke � -� SUBJECT: Midland Chemical Upciate It appears that a negotiation settlement has been reached concerning the Midland Scientific Inc. operation at 1995 West County Road B-2. As you may recall, the City originally issued orders to remove hazardous chemicals on this site in November of 1987. City staff has also been working with the owners of the site and with Midland to relocate them to bring them into compliance with the City's zoning ordinance. The City amended the zoning or��.�nance to allow chemical storage and distribution uses by special use permit in the general industrial zoning districts. In April of 1988, the City approved a special use permit to allow Midland to move to a new site at County Road C and Patton Road. Midland scientific has not relocated and continues to aperate at � 1995 County Road B-2. The special use permit for the new site has lapsed and the City has issued a citation for various code violations. The basis of the settlement would entail the following: 1. Mr. McCormick, the owner, pleads guilty to the various code violations. 2. Mr. McCormick is sentenced to 30 days for said viol��tion. 3. The City will support a suspended sentence based on the requirement that Mr. McCormick be completely out of the building by February 1, 1989. Mr. McCormick has apparently purchased a new site for his business in Brooklyn Center. 4. If Mr. McCormick is not prop�rly vacated by Februar� 1, 1989, the City would then reqaire that his sentence be properly servec�. Staff had reviewed the poten�ial with Pam Zerin from the City Attorney's office regarding inspecting the site with respect to potential hazards that still exisL, however, Pam stated it would be cleanest and "quicker" to ut.ilize the aforementioned settlement.
