Van de North
Briggs and Morgan
Suite 2200 W.
lst National Bank Building
St. Paul, MN 55101
Dear John,
I am enclosing a tax increment policy which requires a 10 open
space dedication, irrespective f acreage size, etc., when a
developer is requesting tax increment assistance from the city in
our 3'win Lakes redevelopment area. I have also enclosed a copy
of the Twin Lakes redevelopment lan, which is approximately 281
acres. am very corcerned about the legality of this policy
based on the recent Suprem Court decisions, and therfore T am
seeking your guidance as to the propriety of requiring the 10
dedication when tax increment is requested. I would also e
interested in your opinion as to whether the city could seek a
10$ opn gace requirement irrespective of whether the
developer is requesting tax increment assistance
Alsa, a city council member is interesed in securing an arts
contribuion of some type in the Twin Lakes redevelopment area as
par of an impact fee. I would be interested in your opinion
regarding the legality of that criterion.
Thank yau frr our assistarace, and Y look forward to your
response.
S ncerel ,
L
1
Cr i . waldron
Bi e tary o Community
Ci of Roseville
:ms
Development
?l(ll (;i'1'I(: (;l:\'1'I:lt 1)hI't: • IZUtiI:'Il.l.l, • .Il\l:U'1:1 • .;,il l.3 • t>(?----3,3?1
