MEMO TO ROBERT BELL
Dated: December 28, 1989 From: John E. Daubney
RE: City of Roseville vs. A Plus Industries
My File No: 10.035
See State vs. Apple Va11ey Readi-Mix, Inc., 379 N.W. 2d 136.
Holding that municipal air pollution and noise ordinances '
that set forth no quantifiable measurement to detrmine whether
heir air quality standards were more stringent than ambient
air quality standards set forth in the State Pollution Control
Statutes conflicted with State Statutes, and therefore rendered
invalid he local ordinance.
M.S.A. § 116.07, subd. 2, relates to the adoption of standazds
by the CA. Relating to noise standards the Statute includes
th following language:
"No local gQvernig unit shall set stndards
describing the maximum level of sound pressure
whic are more stringent tha those set by the
Pollution Control Agency."
It would appear that the Apple Va11ey Readi-Mix case currntly
establishes the supremac of the State Statute if in conflict
with te local ordinance, citing the 1966 Supreme Court cse o
Manqold Midwest Company vs. VillaQe of Richield, 274 Minn. 347,
143 N.. 2d 813.
Sinceres
t, ( 1
; ..1
,7ohn E.
