Holidays means any of the following: New Year's Day, Memorial <br />Day, Independence Day, Labor Day, Thanksgiving Day, Christmas <br />Day and any other holidays mutually agreed to by the City and <br />Contractor. In no instance will there be more than one holiday during <br />a collection week. When the scheduled collection day falls on a <br />holiday, collection in that day's zone and subsequent days' zones <br />will be collected one day later, with Friday being collected on <br />Saturday. When the holiday falls on a Sunday, the subsequent <br />Monday shall be considered a holiday unless the Contractor notifies <br />the City before January 1 of that year that it will not consider that <br />Monday a holiday. <br />The Contractor shall assist the City in publicizing the yearly calendar <br />including alternate collection days. <br />5.15. Weighing of Loads <br />Contractor will keep accurate records consisting of the date, time, <br />collection route, driver's identification, vehicle number, tare weight, <br />gross weight, net weight, and number of recycling stops for each <br />loaded vehicle. Collection vehicles will be weighed empty before <br />collection to obtain a tare weight and weighed after completion of a <br />route or at the end of the day, whichever occurs first. These records <br />shall be maintained on file by the contractor for at least three years in <br />the event of an audit by the City or County. <br />5.16. Ownership <br />Ownership of the recyclables shall remain with the person placing <br />them for collection until Contractor's personnel physically touches <br />the recyclables for collection, at which time ownership shall transfer <br />to the Contractor. <br />5.17. Scavenging Prohibited <br />Any person or persons taking recyclable materials from a recycling <br />container without explicit permission of the inhabitant of a <br />residential dwelling unit or the owner or manager of a Multi Family <br />Complex will be in violation of local ordinance (City Code 403.03) <br />and subject to penalty. The Contractor shall report to the City any <br />instances of suspected scavenging or unauthorized removal of <br />recyclable materials from any collection containers. <br />22 <br />
