updated by the Contractor immediately after any significant changes <br />to the processing facilities used by the Contractor. <br />7.05. Performance Monitoring <br />The City will monitor the performance of the Contractor against <br />goals and performance standards required within this RFP and in the <br />contract. Substandard performance as determined by the City will <br />constitute non-compliance. If action to correct such substandard <br />performance is not taken by the Contractor within 60 days after being <br />notified by the City, the City will initiate the contract termination <br />procedures. <br />The City shall have the right, during the term of the Contract, to have <br />a representative on Contractor's premises to monitor the operation of <br />the Contract. Such representative shall only be allowed on <br />Contractor's premises during normal business hours. <br />7.06. End Market Certification <br />The Contractor shall provide in its Proposal and by January 31 of <br />each year through the term of the contract written certification to the <br />City that all recyclable commodities identified are indeed recycled <br />and not disposed. Such written certification shall identify all end <br />markets manufacturers or processors used for each of the recyclable <br />commodities. The Contractor shall attach written certification from <br />each end market and a list of products manufactured using the <br />recyclable materials collected from the City. The Contractor shall <br />specify the percentage of each material collected that goes to each <br />end market. Contractor must request in writing if it wishes to have <br />the certification be considered proprietary information. <br />8. PAYMENT AND DAMAGES <br />8.01. Term of Contract <br />The term of the new recycling contract will be either a period of <br />three years from January 1, 2014 through December 31, 2016 or a <br />period of five years from January 1, 2014 through December 31, <br />2018. Contractor must submit pricing proposals for both a three-year <br />and afive-year scenario. <br />31 <br />
