EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 4`h day of June 2014, at 5:30 p.m. <br />The following members were present: Chair Michael Boguszewski; and Board Members <br />Robert Murphy and Shannon Cunningham; <br />and none were absent. <br />Variance Board Member Murphy introduced the following resolution and moved its adoption: <br />VB RESOLUTION NO. 103 <br />A RESOLUTION APPROVING A VARIANCE TO §1004.08B (RESIDENTIAL <br />SETBACKS) OF THE ROSEVILLE CITY CODE AT 1836 FERNWOOD AVENUE <br />(PF14-013) <br />WHEREAS, the subject property is described as: <br />PIN: 15-29-23-41-0079 <br />Lot 17, Block 1, Carol's Garden, Ramsey County, Minnesota <br />WHEREAS, City Code §1004.08B would require a 30-foot principal structure setback <br />from the rear property line; and <br />WHEREAS, the owner of the property at 1836 Fernwood Avenue has requested a vAR►A <br />Ce to City Code §�04.08B to allow a proposed home addition to encroach approximately 10 <br />feet into the required rear yard setback; and <br />WHEREAS, City Code §1009.04 (Variances) establishes the purpose of a vARiAtvCE is <br />"to permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />parcel of land or building that prevent the property from being used to the extent intended by the <br />zoning;" and <br />WHEREAS, the Variance Board has made the following findings: <br />a. The practical difficulty stems from the fact that any home addition more than about 5 <br />feet in depth would have to be on the north side of the existing structure—which <br />would be on the opposite side of the garage from the rest of the home's living area; <br />b. The proposed development is generally consistent with the Comprehensive Plan in <br />that it represents continuing investment in a residential property in a way that is <br />compatible with the surrounding neighborhood; <br />c. The proposal is consistent with the intent of the zoning ordinances because the <br />minimum required setback distances from rear property lines are largely intended to <br />preserve the privacy of back yard space for neighboring properties to the rear. <br />
