EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a public hearing was held at the regular meeting of the <br />Variance Board of the City of Roseville, County of Ramsey, Minnesota, on the 3rd day of <br />September 2014, at 5:30 p.m. <br />The following members were present: Chair Michael Boguszewski, Board Member <br />Robert Murphy, and Alternate Board Member James Daire; <br />and Cunningham arrived late due to traffic. <br />Variance Board Member Daire introduced the following resolution and moved its adoption: <br />VB RESOLUTION NO. 106 <br />A RESOLUTION APPROVING VARIANCES TO §1004.02 (ACCESSORY BUILDINGS) <br />OF THE ROSEVILLE CITY CODE AT 389 SOUTH OWASSO BOULEVARD <br />(PF14-021) <br />WHEREAS, the subject property is legally described as: <br />PIN: O 1-29-23-21-0004 <br />The Northeasterly 50 feet of the Southwesterly 210 feet of Lot 3 A. K. Barnum's Garden <br />Lots, according to the recorded plat thereof, Ramsey County, Minnesota. Subject to any <br />and all easements of record. <br />WHEREAS, City Code §1004.02 would require a detached accessory structure to be set <br />back 5 feet from a side property line and 30 feet from a front property line and would require a <br />driveway to be set back 5 feet from a side property line; and <br />WHEREAS, the owner of the subject property, has requested variances to <br />City Code § 1004.02 to allow a proposed detached garage to encroach into the required side and <br />front yards and to allow a proposed driveway to encroach into the required side yard; and <br />WHEREAS, City Code §1009.04 (Variances) establishes that the purpose of a variance is <br />"to permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />parcel of land or building that prevent the property from being used to the extent intended by the <br />zoning;" and <br />WHEREAS, the Variance Board has made the following findings: <br />a. The practical difficulty stems from the fact that even if there were a way to construct <br />an attached or detached garage and driveway that met all code requirements, the <br />garage would certainly compromise (if not entirely eliminate) the front entrance to the <br />home as well as a majority of the home's southerly exposure to the sun; <br />Page 1 of 3 <br />
