Attachment D <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a public hearing was held at the regular meeting of the <br />1 <br />th <br />Variance Board of the City of Roseville, County of Ramsey, Minnesota, on the 4 day of <br />2 <br />November, 2015, at 5:30 p.m. <br />3 <br />The following members were present: <br />4 <br />and the following members absent: <br />5 <br />Variance Board Member _______ introduced the following resolution and moved its adoption: <br />6 <br />VB RESOLUTION NO. 117 <br />7 <br />A RESOLUTION APPROVING 25 FOOT LOT WIDTH VARIANCES TO §1103.06.H <br />8 <br />(LOT STANDARDS) AND 1017.14 (SHORELAND LOT STANDARDS) OF THE <br />9 <br />ROSEVILLE CITY CODE AT 375 SOUTH OWASSO BOULEVARD (PF15-021) <br />10 <br />WHEREAS, City Code §1103.06.H (Lot Standards) states: “Lots abutting upon a water <br />11 <br />course, drainage way, channel or stream shall have an additional depth or width as required to <br />12 <br />assure house sites that meet shoreland ordinance requirements and that are not subject to <br />13 <br />flooding;”and <br />14 <br />WHEREAS, City Code §1017.14 (Shoreland Lot Standards) requires parcels adjacent to <br />15 <br />lakes to be at least 100 feet wide and 15,000 square feet in area; and <br />16 <br />WHEREAS, Ms. Adele Kaufman is proposing to create a recombination of Lots 10 and <br />17 <br />9, Block 3, Lake Owasso Villas, whereby the proposed new parcel will be 75 feet in width, 200+ <br />18 <br />feet in depth, and 16,983 sq. ft. in size; and <br />19 <br />WHEREAS, the proposed new parcel is sub-standard to §1103.06.H and §1017.14 of the <br />20 <br />City Code as it would be 25 feet under the minimum with allowed for new shoreland lots; and <br />21 <br />WHEREAS, the new parcel is legally described as: <br />22 <br />PIN: 01-29-23-21-0094 <br />23 <br />new legal <br />24 <br />WHEREAS, City Code §1009.04 (Variances) establishes the purpose of a is <br />25 VARIANCE <br />“to permit adjustment to the zoning regulations where there are practical difficulties applying to <br />26 <br />a parcel of land or building that prevent the property from being used to the extent intended by <br />27 <br />the zoning;” and <br />28 <br />WHEREAS, the Variance Board has made the following findings: <br />29 <br />a. <br />The code-compliant manner in which to meet the requirement of §1103.06.H (Lot <br />30 <br />Standards) and §1017.14 (Shoreland Lot Standards) have been determined to be <br />31 <br />burdensome and unsuitable for this situation. Such limitations/restrictions represent the <br />32 <br />practical difficulty of the variance request and the proposal appears to compare favorably <br />33 <br />with all of the below requirements essential for approving variances. <br />34 <br />Page 1 of 4 <br /> <br />
