Chair Boguszewski <br />1171 <br />asked that the Commission and public speakers be cognizant of that fact. <br />1172 <br />Ms. Vogel asked that the further distinction be recognized that the zoning had now also <br />1173 <br />been changed. <br />1174 <br />Member Bull also noted a further consideration, with concurrence by Mr. Crain and Ms. <br />1175 <br />Vogel, that the CU became permanent with the property and possibly beyond the use by <br />1176 <br />Vogel Mechanical. <br />1177 <br />Public Comment <br />1178 <br />Glen Davidson, 1780 W County Road C-2 <br />1179 <br />Mr. Davidson admitted that he and his wife “didn’t have a dog in this fight” as they lived <br />1180 <br />far enough away that they didn’t anticipate the Vogel operations would impact them. Mr. <br />1181 <br />Davidson further noted that this was his first involvement in this issue and he had done <br />1182 <br />no research prior to his attendance at tonight’s meeting and was not aware of any <br />1183 <br />previous animosities. <br />1184 <br />Mr. Davidson stated that he was speaking as a retired mechanical engineer of <br />1185 <br />approximately 30 years, and therefore his mindset was more quantitative versus <br />1186 <br />qualitative. Therefore, Mr. Davidson stated that he wouldn’t want to be Vogel Mechanical <br />1187 <br />with some of the conditions suggested, finding them too nebulous and without defining <br />1188 <br />who made those determinations. On the other hand, Mr. Davidson opined that all of the <br />1189 <br />conditions should be and could be measurable through regulating documents or other <br />1190 <br />means. <br />1191 <br />While the fence was intended to stop light, Mr. Davidson questioned if that addressed the <br />1192 <br />spaces between the planks; and if the neighborhood objects about that, who decided the <br />1193 <br />validity of the fence. <br />1194 <br />Being familiar with metal working, and Vogel’s statement that they were in this for the <br />1195 <br />long haul, Mr. Davidson opined that their operations today may not be the same in twenty <br />1196 <br />years at which time they could be grinding, sawing, riveting, arc welding, painting, acid <br />1197 <br />dipping or other activities depending on technology, the business and the market for their <br />1198 <br />materials. Mr. Davidson questioned what odor emissions would be involved with those <br />1199 <br />long-term operations. <br />1200 <br />To avoid future animosities and/or ambiguities, Mr. Davidson suggested making sure the <br />1201 <br />approval process at this time adequately serve all parties. <br />1202 <br />Cassandra Yunker, 2852 Wheeler Street N <br />1203 <br />Living in close proximity to neighbors bordering the Vogel property, Ms. Yunker <br />1204 <br />expressed her respect for what they were trying to accomplish. Ms. Yunker expressed <br />1205 <br />concern with removal of the previous fence leaving the neighborhood yards exposed and <br />1206 <br />removal of trees and rough trimming and negative aesthetics as a result. If the Vogels <br />1207 <br />don’t have to replace those fences now, or if the fence is not on the property line to block <br />1208 <br />the properties in case there should be a gap, Ms. Yunker questioned what resolution was <br />1209 <br />then available to the neighbors; and since their trees and yards had been destroyed, <br />1210 <br />where were their children or grandchildren supposed to play. Given the open area now <br />1211 <br />evidenced adjacent to the Vogel property, Ms. Yunker expressed concern with the overall <br />1212 <br />situation, and also her concern that it seemed a difficult situation to rectify. However, Ms. <br />1213 <br />Yunker admitted she didn’t understand what everyone was supposed to do now under <br />1214 <br />those circumstances. <br />1215 <br />With the request by Member Murphy as to who cut the trees down along the previous <br />1216 <br />Kathleen Ericson, <br />fence installation, Ms. came up from the audience and advised that <br />1217 <br />the first cutting down the middle had been done by Xcel Energy at the request of Vogel <br />1218 <br />as well as for safety before building the fence, a second cutting done by Twin Cities Tree <br />1219 <br />Service at the request of Vogel and as their vendor without any notice to neighbors and <br />1220 <br />cutting along the fence line. <br />1221 <br /> <br />
