Special Planning CommissionMeeting <br />Minutes –Wednesday, September 17, 2015 <br />Page 23 <br />located on the Vogel Mechanical property and not closing until 2:00 a.m., it could prove <br />1095 <br />disruptive, as well as other potential uses. <br />1096 <br />Chair Boguszewski stated he would be much more uncomfortable with a 10:00 p.m. restriction, <br />1097 <br />using as an example, people just getting wound up after dinner or a movie by 10:00 p.m.While <br />1098 <br />he may be willing to consider a Midnight tor 1:00 a.m. closing time, Chair Boguszewski stated he <br />1099 <br />would find a 10:00 p.m. closing too restrictive, noting that Target is open until 11:00 p.m. <br />1100 <br />Member Bull admitted he frequently utilized stores later in the night. <br />1101 <br />Member Cunningham respectfully asked Member Bull to consider how that might impact him if <br />1102 <br />that was immediately adjacent to his backyard. <br />1103 <br />Member Murphy noted other CMU areas with 2:00 a.m. as the closing time as well. <br />1104 <br />Member Bull expressed his concern in limiting business opportunities interested in coming into <br />1105 <br />Roseville if the regulations were too restrictive and whether than may keep potential users from <br />1106 <br />exploring those areas. <br />1107 <br />Chair Boguszewski asked, if the time was pulled from 2:00 a.m. back to Midnight, depending on <br />1108 <br />the nature of a potential use or business, askedstaff if there was a variance process that would <br />1109 <br />apply, with staff responding that would be an option and an appropriate route to consider. <br />1110 <br />Member Bull agreed that a variance process may be appropriate; however, if a business was <br />1111 <br />considering locating in Roseville, would they review restrictions first noting that additional step in <br />1112 <br />the process. <br />1113 <br />Chair Boguszewski opined that they would probably look at the park dedication fee and other fees <br />1114 <br />as the first step that may deter their interest. <br />1115 <br />While understandingthe various points made by her colleagues, Member Cunningham opined <br />1116 <br />that, if they wanted it to work, they’d come forward; but reiterated if CMU-1 is intended to be a <br />1117 <br />buffer zone, a business operating until 2:00 a.m. was not a buffer and questioned if thattype of <br />1118 <br />use was therefore desirable in this location anyway. <br />1119 <br />Chair Boguszewski suggested, in the newly rewritten Item 6.a, that it be changed from 2:00 a.m. <br />1120 <br />to Midnight, and otherwise mimic Item 6.b related to delivery traffic. <br />1121 <br />Member Bull sought clarification as to whether the intent of Chair Boguszewski was also to <br />1122 <br />restrict employee time as well in Item 6.c as well. <br />1123 <br />Mr. Lloyd clarified that this section was the one raised via e-mail by Member Stellmach and <br />1124 <br />discussed at the previous meeting regarding various issues, some of which were maybe being <br />1125 <br />stumbled over now.By breaking up Sections 6.a, b and c, Mr. Lloyd advised that in thinking about <br />1126 <br />retail or non-retail uses over the course of a day, his attempt had been to break them down. <br />1127 <br />However, in retrospect, Mr. Lloyd suggested perhaps an additional section 6.d that addressed <br />1128 <br />both retail and non-retail businesses for CMU-1 designations, and another for each of the other <br />1129 <br />district designationsrather than as currently written.Mr. Lloyd sought clarification from the <br />1130 <br />Commission as to whether they wanted to include customer or non-customer traffic as part of <br />1131 <br />those provisions as well. <br />1132 <br />Based on previous discussion, Chair Boguszewski responded that the restriction was for <br />1133 <br />customers or others coming in, not necessarily workers (e.g. a baker can arrive on site, but not <br />1134 <br />welcome the public until a later time). <br />1135 <br />Mr. Bilotta suggested restricting customers and deliveries as applicable per CMU designation <br />1136 <br />area.Mr. Bilotta stated that staff would refine the language to address the time differences and <br />1137 <br />restrictions per tonight’s discussion (e.g. Midnight versus 2:00 a.m.). <br />1138 <br />Chair Boguszewski sought consensus for revising language for CMU-1 designated areas for <br />1139 <br />customers, deliveries and external traffic from 2:00 a.m. to Midnight. <br />1140 <br />Member Murphy stated he was inclined to consider a 1:00 a.m. restriction. <br />1141 <br />Member Bull noted that would address a potential use such as a pizza delivery shop. <br />1142 <br /> <br />
