10/08/2014 <br /> Agenda Date: <br />REQUEST FOR PLANNING COMMISSION ACTION5d <br /> Agenda Item: <br />Division Approval Agenda Section <br />PH <br />UBLICEARINGS <br />Item Description: Request by Community Development Department for a Zoning Text <br />Amendment to §1009.03 Interim Uses <br />(PROJ0017, Amdt 23) <br />There is no mandated deadline due to City Staff initiated request. <br />GI <br />ENERALNFORMATION <br />Applicant: <br /> Roseville Community Development Department <br />Type of Request: <br /> Zoning Ordinance text amendments <br />LCDD-M <br />EVEL OF ITYISCRETION IN ECISIONAKING <br />legislative <br />Action taken on a variance request is ; the City <br />has broad discretion in making land use decisions based on <br />advancing the health, safety, and general welfare of the <br />community. <br />B <br />ACKGROUND <br />1 <br />At the September 15, 2014, City Council meeting, the Community Development Director <br />2 <br />discussed the Interim Use process and possible amendments the City Council could consider for <br />3 <br />future flexibility and to potentially address Vogel Sheetmetal’s non-conforming use and pending <br />4 <br />loan situation. <br />5 <br />The City Council provides the Planning Staff comments pertaining to their views of interim use <br />6 <br />and whether such uses should be permitted for long terms. Specifically, Community <br />7 <br />Development Director Bilotta addressed the Council discussion possible modifications the <br />8 <br />Council could consider in support of longer term interim uses. City Council Members, however, <br />9 <br />were concerns over the appropriateness of extending interim use beyond the current 5- year term <br />10 <br />and also, if a longer timeframe were supported, how could the Council seek additional conditions <br />11 <br />if issues arose. <br />12 <br />The discussion indicated a desire to look at the Interim Use process to see if it should be made <br />13 <br />more flexible. However, there was hesitancy to open them up completely without some sort of <br />14 <br />periodic review process (see Attachment A) <br />15 <br />The Council directed the Planning staff review the Interim Use section and proposed <br />16 <br />modifications through the formal amendment process. <br />17 <br />PROJ-0017_Amdt22_100814 <br />Page 1 of 3 <br /> <br />
