DraftSubdivisionOrdinanceΑAttachmentA <br />subdivisionstandardsandtoensurethatapprovaloftherequestwillnotbeinjuriousto <br />thesurroundingneighborhoodandwillnototherwiseharmthepublichealth,safety, <br />andgeneralwelfare. <br />2.Action:UponreceivinginputfromtheDevelopmentReviewCommittee,theCommunity <br />DevelopmentDepartmentshallhavetheauthoritytoapproveorden <br />ytherequest. <br />3.Appeal <br />a.IfaType1subdivisionisdeniedapproval,anappealmaybefiledbytheapplicant. <br />Suchappealshalladheretothefollowing: <br />i.TheappealshallbesubmittedtotheCityManagerwithin10calendardaysafter <br />theactionbeingappealed. <br />ii.Theappealshallstatethespecificgroundsuponwhichtheappealismade. <br />iii.TheappealshallbeaccompaniedbythefeesetforthinChapter314ofthis <br />Code. <br />b.Whenanappealisfiled,apublicmeetingregardingthemattershallbeheldbefore <br />theCityCouncil,actingastheBoardofAdjustmentsandAppeals,ataregular <br />meetingheldwithin30daysofthereceiptoftheappeal.TheBoardofAdjustments <br />andAppealswillreconsideronlytheevidencethathadpreviouslybeenconsidered <br />aspartoftheformalactionthatisthesubjectoftheappeal.Neworadditional <br />informationfromtheappealsapplicant(s)maybeconsideredbytheBoardof <br />AdjustmentsandAppealsatitssolediscretion,ifthatinformationservestoclarify <br />informationpreviouslyconsideredbystaff. <br />ЊЉЉЍ͵ЉЋǤƦĻЋ{ǒĬķźǝźƭźƚƓƭʹ <br />A.Purpose:AType2subdivisionisintendedtobeamoreformalizedprocessresultingina <br />simpleplatwhichwillfurtherdeveloppropertyconsistentwiththeprovisionsofthisTitleand <br />withoutsignificantimpactstothebroaderneighborhood.Duetotheinherentsimplicityofa <br />Type1subdivision,apublichearingisnotrequired,andpreliminaryandfinalreviewandaction <br />maybeconsolidatedintoasingleprocess.Type2subdivisionsarethosewhich: <br />1.compriseadjustmentstoexistingparcelsand/orcreateupto3newparcels; <br />2.donotrequirenewpublicinfrastructure; <br />3.donotrequireacomprehensiveplanamendment,zoningamendment,orvarianceto <br />complywithsubdivisionorzoningstandards;and <br />B.Exceptions:Ifanypartofasubdivisionproposalfailstomeetanyoftherequirementsfor <br />Type2subdivisionsestablishedinthisSection,itshallbeineligibleforType2subdivision <br /> <br />
