Attachment D <br />Attachment B <br />6. <br />Pruning of oak trees and elm trees shall be subject to the following requirements: <br />369 <br />thst <br />a.Pruning of Oak trees shall not occur from March 15 through July 1. <br />370 <br />stst <br />b.Pruning of Elm trees shall not occur from April 1 through August 31. <br />371 <br />c.On a year to year basis, the City Council may alleviate or extend the above <br />372 <br />seasonal restrictions by resolution if, in its opinion, the same is necessary for <br />373 <br />the betterment of city wide oak and elm tree populations. <br />374 <br />d.If pruning of either tree type is absolutely necessary during prohibited <br />375 <br />timeframes, the city shall be notified before work begins, and the landowner <br />376 <br />shall be required to seal all wounds with a proper wound sealing paint <br />377 <br />authorized by the City Forester or other registered forester or certified arborist <br />378 <br />as assigned by the Community Development Department. <br />379 <br />7. <br />Unplanned Loss of Trees. <br />380 <br />a.Any tree, not previously identified for removal, that is determined by the City <br />381 <br />Forester or other registered forester or certified arborist as assigned by the <br />382 <br />Community Development Department to be destroyed or damaged as a result of <br />383 <br />development activity shall be replaced at the following rates: <br />384 <br />b.Unauthorized tree removal which results in mandatory replacement shall <br />385 <br />require the applicant to prepare or update a final planting plan as required by <br />386 <br />Section 1011.04(G)(3)(c). Replacement plantings shall only occur once <br />387 <br />authorized by the City Forester or other registered forester or certified arborist <br />388 <br />as assigned by the Community Development Department. <br />389 <br />L.Certificationof Compliance with Approved Landscape Plan <br />390 <br />Upon completion of construction activity and/or required landscaping, the Developer <br />391 <br />shall notify the City and request an inspection of the work. Following the inspection, <br />392 <br />the City shall notify the Developer that additional work is still required, or issue a letter <br />393 <br />finding that all plantings have been satisfactorily completed. The required warranty <br />394 <br />period for plantings shall begin on the date of the issued satisfactory completion letter. <br />395 <br />M.Warranty Requirement <br />396 <br />1. <br />New Development Sites: the Developer shall provide a financial guarantee, in a <br />397 <br />form satisfactory to the City, prior to the approval or issuance of any permit for <br />398 <br />land alteration <br />399 <br />400 <br />1213 <br />Page of <br /> <br />
