AttachmentA <br />1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />PUBLIC IMPROVEMENT CONTRACT <br />11 <br />WHEATON WOODS <br />12 <br />13 <br />14 <br />Parties. <br />I.This Agreement, dated ____________,2016, is entered into between the Cityof Roseville, <br />15 <br />a Minnesota municipal corporation, whose address is2660 Civic Center Drive, Roseville, Minnesota <br />16 <br />City <br />55113 (“the ”), andGolden Valley Land Company, Inc., aMinnesota corporation, whose <br />17 <br />Developer <br />address is 6001 Glenwood Ave., Golden Valley, MN 55422 (the “”). <br />18 <br />Request for Plat approval. <br />II.The Developerhas asked the Cityto approve a plat of land to be known <br />19 <br />Wheaton Woods <br />as “”(also referred to in this Agreement as the “Plat”). The land is legally <br />20 <br />described as follows: <br />21 <br />See Legal Description attached as Exhibit Ahereto (the “Property”). <br />22 <br />23 <br />Terms and Conditions of Plat Approval. <br />III.For good and valuable consideration, the receipt and <br />24 <br />sufficiency of which are hereby acknowledged, the parties agree as follows: <br />25 <br />Plat Approval: <br />A.Subject to the terms and conditionsof this Public Improvement Contract, the <br />26 <br />recitals above, and all other applicable City Code provisions, the City hereby approves the recording <br />27 <br />of the Plat. <br />28 <br />Land Use: <br />B.The plat consists of 17 single family lots (11 LDR-1 lots and 6 LDR-2 lots). The <br />29 <br />property is to be improved with the following: public street and curbing, bioretention ponds, <br />30 <br />sanitary sewer lines, watermain lines and hydrants, and storm sewer lines with structures. <br />31 <br />Public Improvements. <br />C.The Developer shall, subject to the terms and conditions contained herein, <br />32 <br />perform the following work and construct the following improvements (“Public Improvements”) in <br />33 <br />compliance with City approved Public Improvement Construction Plans described in Section III D <br />34 <br />below and all rules, regulations, standards and ordinances of the City: <br />35 <br />1.Site Grading and Turf Restoration.The Developers shall grade the Property in <br />36 <br />accordance with the City approved Grading, Drainage and Erosion Control Plan. Site <br />37 <br />grading improvements shall include common excavation, subgrade correction, <br />38 <br />embankment and pond excavation. The Developer shall turf restoration on the Property <br />39 <br />which shall includeseeding, mulching and erosion control. <br />40 <br />a)The Developershall submit to the Citya site grading and drainage plan for the entire <br />41 <br />Plat acceptable to the Cityshowing the grades and drainage for each lot prior to <br />42 <br />installation of the improvements. <br />43 <br />Page 1of16 <br /> <br />
