d)Grading Notes and Details <br />1 <br />e)Street,Sanitary Sewer and Watermain Details <br />2 <br />f)Tree Preservation Plan <br />3 <br />g)Sanitary Sewer,Watermain, Storm Sewer and Street plan. <br />4 <br />h)Landscaping Plan. <br />5 <br />Other <br />i) <br />6 <br />Notice to Proceed. <br />E.The improvements shall be installed in accordance with the City approved Plans <br />7 <br />and the rules, regulations, standards and ordinances of the City. The plans and specifications shall <br />8 <br />be prepared by a competent registered professional engineer, furnished to the City for review, and <br />9 <br />shall be subject to the approval of the City Engineer. No work shall commence on the Property until <br />10 <br />the City Engineer notifies the Developer that the work can commence. <br />11 <br />1.The Developershall obtain all necessary permits from the Minnesota Pollution Control <br />12 <br />Agency (MPCA), Minnesota Department of Health (MDOH), and other agenciesand <br />13 <br />governmental authoritiesbefore proceeding with construction. Copies of these permits <br />14 <br />must be provided to the City Engineer. <br />15 <br />2.The Developeror itsengineer shall schedule a preconstruction meeting at a mutually <br />16 <br />agreeable time at CityHall with all the parties concerned, including Citystaff, to review <br />17 <br />the program for the construction work. <br />18 <br />3.TheDeveloperrepresents to the City that the Plat complies with all City,County, <br />19 <br />Metropolitan, State and Federal laws and regulations including, but not limited to: <br />20 <br />subdivision ordinances, zoning ordinances and environmental regulations. If the City <br />21 <br />determines that the Plat does not comply, the Citymay, at its option, refuse to allow <br />22 <br />construction or development work on the Propertyuntil the Developerdoes comply. <br />23 <br />Upon the City’s demand, the Developershall cease work until there is compliance. <br />24 <br />25 <br />Time of Performance. <br />F.The Developer shall completeall required improvements enumerated in <br />26 <br />. <br />Paragraph Cby October 1, 2016The Developermay, however, forward a request for an extension <br />27 <br />of time to the City. If an extension is granted, it shall be conditioned upon updating the security <br />28 <br />posted by the Developerto reflect cost increases and the extended completion date. <br />29 <br />Inspection. <br />G.The Developer shall provide the services of a Project Representative and assistants at <br />30 <br />the site to provide continuous observation of the work to be performed and the improvements to be <br />31 <br />constructed under this Agreement. <br />32 <br />1.The Developer shall provide the City Engineer a minimum of one business day notice <br />33 <br />prior to the commencement of the underground pipe laying and service connection; and <br />34 <br />prior to subgrade, gravel base and bituminous surface construction. <br />35 <br />2.Developer’s failure to comply with the terms of this section shall permit the City <br />36 <br />Engineer to issue a stop work order which may result in a rejection of the work and <br />37 <br />which shall obligate the Developer to take all reasonable steps, as directed by the City <br />38 <br />Engineer to ensure that the improvementsare constructed and inspected pursuant to the <br />39 <br />terms of this Agreement; and shall further result in the assessment of a penalty, in an <br />40 <br />Page 4of16 <br /> <br />
