EXTRA►CT O� MINUTES OF MEETING OF THE <br />VARIANCE BOARD QF THE CITY QF R4SEVILLE <br />� Pursuant to due call and notice thereof, a public hearing was held at the regular rneeting of the <br />2 Variance Board of the City of Rosevil�e, County of Rarnsey, Minnesota, on the 4`h day of May, <br />3 2016, at 5:30 p.m. <br />a The following members were present: Chair Rabert Murphy, 3ames Daire, and Chuck <br />s Gitzen and the following members absent: None <br />s Variance Board Mernber �3aire intraduced the following resolution and rnoved its adoption: <br />i VS RES(]LUTIOl'�1 NO. 121 <br />s A RES[3LUTI�N APPROVING A VARIANCE TO §10Q4.02, ACCESSf)RY BUILDINGS, <br />s TABLE 1004-1, OF THE RQSEVILLE CITY CODE AT 2040 YRENE STREET <br />i a (PF16-011) <br />11 `NHEREAS, City Code §lOQ4.U2, Accessory Buildings, Table 1004-1, does not allow a <br />� 2 accessary structure {shed) in the frant yard; and <br />�3 WHEREAS, the property owners seek to construct a garden shed a minimum of 16 feet <br />�a from the Irene Street curb and within the frant yard; and <br />�� WHEREAS, the sub}ect property is legally described as: <br />1E <br />Lot 11, Block 2, McCarron's Addition <br />�7 'WHEREAS, City Code §�()09.Q4 (Variances) establishes that the purpose of a vA���.tvcE <br />�s is ``to permit adjustment to the zoning reg�lations where there are practical dif%cuities applying <br />� � to a parcel of land or building that prevent the property frorn being used to the extent intended by <br />2o the zaning;" and <br />�i WHEREAS, the Variance Board has made the follawing findings: <br />22 a. The eode-compiiant manner in which to meet the r�quirements of §10�i4.(}2, <br />23 Accessory Structures, Table 1004-1, has been dete�ined to be burciensorne for this <br />2a situation. Such limitations/restrictions represent the practical difficulty of �he <br />2� varianee request and the proposai appears to compare favorabl}� with all of the above <br />2s requirements essential for approv�ng variances. <br />2; b. The proposai is generally consistent with the Comprehensive Plan because the <br />t8 addition of a useable shed and its locatian is more functional and represents t�ie sort <br />2g of reinvestment promoted by the Comprehensive Plan's gvals and policies for <br />34 residential areas. <br />Page 1 af 4 <br />
