SR <br />TAFF COMMENT AND ECOMMENDATION <br />21 <br />The Planning Division has reviewed the recently established requirements and considered the <br />22 <br />interests of the City Council to determine the best approach to modify the existing language. In <br />23 <br />its review, the Division determined that both subsections could use additional clarifying points to <br />24 <br />better assist developers with tree replacement. Specifically, as currently written, the Code <br />25 <br />requires that either trees be planted on public lands or a cash payment be submitted to the City. <br />26 <br />Planning Division staff believes that the requirement should not be an either/or situation, but <br />27 <br />rather a combination of the two, which would better assist developers in achieving compliance <br />28 <br />with these requirements. <br />29 <br />The Planning Division, therefore, recommends that these subsections be revised as follows: <br />30 <br />Eliminate public boulevard plantings since such locations are few and other City Code <br />31 <br />sections discourage or prohibit planting of trees in the boulevard. <br />32 <br />Include language that supports a developer working with residents directly adjacent to a <br />33 <br />proposed development site, whereby replacement trees can be planted on private property. <br />34 <br />Include language that supports the planting of replacement trees on public improvement <br />35 <br />projects in the general area. <br />36 <br />Modify the public land statement to support tree replacement on such lands that are in the <br />37 <br />general area. <br />38 <br />Modify subsection “b” to support the use of the required fee in combination with any of the <br />39 <br />above options. <br />40 <br />The Planning Division recommends the following proposed amendments to §1011.04.J.8: <br />41 <br />J.Replacement Tree Locations. Required replacement trees shall be planted on the site being <br />42 <br />developed unless doing so is deemed to be impractical (i.e., due to lack of space), <br />43 <br />inappropriate (available planting areas are not ideal for new plantings or would do little to <br />44 <br />enhance the site), or counterproductive to a property’s intent (i.e., would entail too much <br />45 <br />screening for a retail business) as determined by the City Forester or other degreed forester <br />46 <br />or certified arborist as assigned by the Community Development Department. When such a <br />47 <br />determination is made, the applicant shall comply with replacement requirements in one of <br />48 <br />in the following manner <br />two ways : <br />49 <br />a. <br />As directed by the City, required replacement trees may be located on public boulevards <br />50 <br />private property directly adjacent to the subject development site, on public <br />51 <br />improvement project sites that are not greater than 1000 feet from the development <br />52 <br />site,onthat are not greater than1000 feet from <br />or other public lands throughout the City <br />53 <br />the development site, <br />, if such lands are deemed to be available with priority given to <br />54 <br />locations within or near the affected area; or <br />55 <br />b.tree replacement <br />The City may accept a cash-in-lieu payment in accordance with the <br />56 <br />a <br />required fee listed in the City Fee Schedule. In no instance shall cash-in-lieu of payment <br />57 <br />; or <br />exceed 10% of the Fair Market Value of the development site <br />58 <br />c.The City may approve a combination of tree replacement in accordance with “a” above <br />59 <br />and a payment consistent with “b” above to fulfill this requirement. <br />60 <br />PROJ0017_RPCA_060116TreePres <br />Page 2 of 3 <br /> <br />
