watersystem if a water main is available to the property unless the City Council approves a private <br />well where unusual circumstances exist. <br />2. Water Main Unavailable: Where new homes or buildings do not have a water main <br />available to the property, the City Council shall determine whether and under what <br />conditions the Municipal water system will be extended to serve the property or a private <br />well allowed. (Ord. 530, 3-20-1967) <br />D. Existing Private Water System: Existing private water systems may be continued and <br />maintained, Private wells serving such systems may not be drilled without a permit from the <br />Director ofPublic Works or the City Council. (Ord. 891, 12-14-1981) <br />E. Per�nit Required: No person shall drill any well without first obtaining a permit. Application <br />for such permit shall state the character, location and size of the proposed well. The permit fee <br />shall be set by City Council resolution. (Ord. 891, 12-14-1981) <br />F. Requirements For Issuance: The Director of Public Works shall issue such pennits only if <br />one of the following exists: <br />1. The well will only serve one single-family residence, and the use of the Municipal system <br />would create a health problein for the occupants of such single-family dwelling. <br />2. The well is to be used for monitoring purposes only and will be abandoned in accordance <br />with State regulations at a set future date. <br />3. All other wells shall require a permit from the City Council. The City Council will issue <br />such permits only after a determination that the private well will not interfere with the <br />Municipal system and that the property cannot be served by the existing Municipal system. <br />(Ord. 891, 12-14-1981; 1995 Code) <br />4. Upon the completion of the drilling of each and every well, the well driller shall notify the <br />Chief Code Enforcement Officer and shall furnish the Chief Code Enforcement Officer with a <br />visual pumping test of sufficient duration to determine the yield which shall be of a minimum <br />rate of ten (10) gallons per minute. Within ten days after such a test of a well, the well driller <br />shall file an affidavit with the Chief Code Enforcement Officer setting forth the results of the <br />test, the capacity of the well, the pumping level, the depth of casing from grade and a <br />description of the screen or rock formation. (Ord. 276, 5-19-1959; 1995 Code) <br />G. Well Pumps: No person shall install or replace a pump without first obtaining a permit to do <br />so. Application for a permit to install or replace a pump for a well shall be made in writing to <br />the Chief Code Enforcement Officer and shall state the manufacturer, type, horsepower and <br />rating of the proposed pump to be installed or replaced. The permit fee shall be set by City <br />Council resolution. (Ord. 873, 12-22-1980; 1995 Code) <br />801.28 : PRIVATE USE OF WATER TOWERS: <br />A. Permit Required: No person shall in any way use any Municipal water tower for private use <br />without first obtaining a permit from the City Council to do so. <br />B. Fee: If the permit is issued by the City Council, it shall be valid only as long as the applicant <br />pays to the City the fee as set by City Council resolution. The permit must be renewed <br />annually. <br />C. Cancelling Permits: The City Council may at any time cancel any permit issued to aprivate <br />person to in any way use any City Municipal water tower by returning to the person the <br />unused portion of the annual fee. (Ord. 419, 4-20-1964; 1995 Code) <br />Section 2. Effective Date. This ordinance amendment to the City Code shall take effect upon the <br />passage and publication of this ordinance. <br />11 <br />
