A theater, concert hall, <br />auditorium, or similar commercial establishment <br />which regularly features persons who appear in a <br />state of nudity or live performances which are <br />characterized by the exposure of "specified <br />anatomical areas" or "specified sexual activities". <br /> <br />SECTION 2. Sections 1005.03(A), 1005.04(A), 1005.06(B), 1005.07(A)and 1005.02(A) <br />of Title 10 of the Roseville City Code are amended by adding Sexually Oriented Uses - Principal <br />and Accessory, as permitted uses. <br /> <br />SECTION 3. Title 10 of the Roseville City Code is amended by adding a new Chapter <br />1017 to read as follows: <br /> <br />1017.01: <br /> <br />1017.02: <br /> <br />1017.03: <br /> <br />100177 <br /> <br />CHAPTER 1017 <br /> <br />SEXUALLY ORIENTED USES <br /> <br />PURPOSE: The purpose of this Chapter is to establish proVlSlOns for the <br />opportunity as well as controls of sexually oriented uses within the City ofRoseville. <br /> <br />GENERAL PROVISIONS: Sexually oriented uses as defined in this ordinance <br />shall be subject to the following general provisions. <br /> <br />A. <br /> <br />Activities classified as obscene as defined by Minn. Stat. § 617.241 are not <br />permitted and are prohibited. <br /> <br />B. <br /> <br />Sexually oriented uses, either principal or accessory, shall be prohibited ftom <br />locating in any building which is also used for residential purposes. <br /> <br />C. <br /> <br />Sexually oriented uses, either principal or accessory, shall be prohibited ftom <br />locating in any building which is also licensed to sell intoxicating liquor, non- <br />intoxicating malt liquor or wine. <br /> <br />D. <br /> <br />A sexually oriented use which does not qualify as a sexually oriented use-accessory, <br />shall be classified as a sexually oriented use-principal. <br /> <br />SEXUALLY ORIENTED USES - PRINCIPAL: <br /> <br />A. <br /> <br />Sexually oriented uses-principal shall be located at least 1320 radial feet, as <br />measured in a straight line ftom the closest point of the property line of the building <br />upon which the sexually oriented use, principal is located to the property line of: <br /> <br />1.
