<br />City of Roseville <br />ORDINANCE No. 1270 <br /> <br />AN ORDINANCE AMENDING TITLE 10, SECTION 1016, SHORELAND <br />DISTRICT, BY ADDING LANGUAGE WHICH DEFINES FENCES AS <br />STRUCTURES WHEN PLACED IN THE SHORELAND DISTRICT AND <br />PROHIBITS PLACEMENT OF FENCES SHOREWARD OF THE PRINCIPAL <br />STRUCTURE OR ANY PERMITTED DECK. <br /> <br />THE CITY OF ROSEVILLE ORDAINS: <br /> <br />SECTION 1. Purpose. The Roseville City Code, Title 10, Section 1016, is hereby <br />amended by adding or revising language necessary to define fences as structures within <br />the Shore land District and to provide additional regulation regarding their placement on <br />property with water frontage. The purpose of this ordinance is to provide visual access, <br />private open space, and reduced impacts of man-made structures within the non-buildable <br />portion of the Shoreland District, between the principal structure and the shore line. <br /> <br />SECTION 2. Section 1016.05 (Definitions) is hereby amended as follows: <br /> <br />STRUCTURE: Any building or appurtenance, including attached or detached <br />decks and fences. "Structure" does not include aerial or underground utility lines, <br />such as sewer, electric, telephone, telegraph, gas lines, towers, poles, seasonal <br />docks, and other supporting facilities such as at-grade driveways and patios. <br /> <br />SECTION 3. Section 1016.16 B. (Additional Structure Standards For All Districts) is <br />hereby amended by adding the following subsection 3 as follows: <br /> <br />Section 1016.16 B 3. In bluff impact, shoreland, and wetland zones, fences shall <br />be setback the same distance from the shore line as required for the principal <br />structure or attached deck on the lot, except that a fence on a lot with a pre- <br />existing principal structure and attached deck may extend to the same setback as <br />the deck or the structure. Fences shall be of similar design, texture, and color as <br />the principal structure or shall be of an earth tone or color and material. <br /> <br />Fences used for safety or containment may be set within 25 feet of the OHWL. <br />Such fences shall be a maximum of 25% opaque, and no more than 42 inches in <br />height. Such fences shall be clad in earth tone coatings. <br /> <br />With the exception of regulations in this subsection, fences in bluff impact, <br />shoreland, and wetland zones shall meet all height and setback requirements of the <br />City Code, Section 1012.02. Fences placed on the road side ofa lot with water or <br />wetland frontage shall comply with front yard fence requirements of City Code, <br />Section 1012.02. <br /> <br />SECTION 4. Effective Date. This ordinance shall take effect following its passage and <br />publication. <br /> <br />1 <br />
